October 14. 2008 At a Regular Meeting of the City Council on Tuesday, October 14, 2008, there were present: Mayor James W. Holley III, Vice Mayor William E. Moody, Jr., Marlene W. Randall, Elizabeth M. Psimas, Douglas L. Smith, Charles B. Whitehurst, Sr., City Manager Kenneth L. Chandler, City Attorney G. Timothy Oksman. Councilwoman Marlene Randall opened the meeting with prayer, which was followed by the Pledge of Allegiance to the Flag. Mayor Holley called the meeting to order and welcomed all in attendance. Motion by Mr. Whitehurst, and seconded by Mr. Moody, to approve the minutes of noon and 6 p.m. Called Meetings of September 22, 2008, of a Called Meeting of September 23, 2008, of a Regular Meeting of September 23, 2008, and of a Called Meeting of October 6, 2008, and was adopted by the following vote: Ms. Randall read the following statement: "I would like for the minutes to reflect that at the meeting on September 23, 2008, during the vote on rescinding the eminent domain of the crab shack property, I voted in error when in fact I was in full support of rescinding the previous vote for eminent domain of this property." Ayes: Moody, Psimas, Randall, Smith, Whitehurst, Holley Nays: None - Public Hearing - 08 - 434 - Public hearing on use permit applications: (a) UP-08-16 DOWNTOWN SOUTH - James Spacek, Director of Public UtilitieslPublic Works, requests a use permit to build a new pump station at 512 South Street. The Comprehensive Plan's Generalized Future Land Use Map recommends mixed use downtown development in this area. Vision Principle: A Robust and Prospering Economy. 1. R. C. Smith, 13 Columbia Court, voiced his concern with the level of noise and odor that may be emitted by the pump station. Motion by Ms. Psimas, and seconded by Ms. Randall, to concur with the recommendation of the Planning Commission that UP-08-16 be approved on first reading, and was adopted by the following vote: Ayes: Moody, Psimas, Randall, Smith, Whitehurst, Holley Nays: None (b) UP-08-17 DOWNTOWN - Charles Greenhood requests a use permit to operate an entertainment establishment at 467 Court Street. The Comprehensive Plan's Generalized Future Land Use Map recommends mixed use downtown development in this area. Vision Principle: A Robust and Prospering Economy. There were no speakers. Motion by Mr. Moody, and seconded by Mr. Whitehurst, to concur with the recommendation of the Planning Commission that UP-08-17 be approved on first reading, and was adopted by the following vote:
