<br />October 14. 2008 <br /> <br />At a Regular Meeting of the City Council on Tuesday, October 14, 2008, there <br />were present: <br /> <br />Mayor James W. Holley III, Vice Mayor William E. Moody, Jr., Marlene W. Randall, <br />Elizabeth M. Psimas, Douglas L. Smith, Charles B. Whitehurst, Sr., City Manager <br />Kenneth L. Chandler, City Attorney G. Timothy Oksman. <br /> <br />Councilwoman Marlene Randall opened the meeting with prayer, which was <br />followed by the Pledge of Allegiance to the Flag. <br /> <br />Mayor Holley called the meeting to order and welcomed all in attendance. <br /> <br />Motion by Mr. Whitehurst, and seconded by Mr. Moody, to approve the minutes <br />of noon and 6 p.m. Called Meetings of September 22, 2008, of a Called Meeting of <br />September 23, 2008, of a Regular Meeting of September 23, 2008, and of a Called <br />Meeting of October 6, 2008, and was adopted by the following vote: <br /> <br />Ms. Randall read the following statement: <br /> <br />"I would like for the minutes to reflect that at the meeting on September 23, 2008, during <br />the vote on rescinding the eminent domain of the crab shack property, I voted in error <br />when in fact I was in full support of rescinding the previous vote for eminent domain of <br />this property." <br /> <br />Ayes: Moody, Psimas, Randall, Smith, Whitehurst, Holley <br />Nays: None <br /> <br />- Public Hearing - <br /> <br />08 - 434 - Public hearing on use permit applications: <br /> <br />(a) UP-08-16 <br /> <br />DOWNTOWN SOUTH - James Spacek, Director of Public <br />UtilitieslPublic Works, requests a use permit to build a new pump <br />station at 512 South Street. The Comprehensive Plan's <br />Generalized Future Land Use Map recommends mixed use <br />downtown development in this area. Vision Principle: A Robust <br />and Prospering Economy. <br /> <br />1. R. C. Smith, 13 Columbia Court, voiced his concern with the level of noise and odor <br />that may be emitted by the pump station. <br /> <br />Motion by Ms. Psimas, and seconded by Ms. Randall, to concur with the <br />recommendation of the Planning Commission that UP-08-16 be approved on first <br />reading, and was adopted by the following vote: <br /> <br />Ayes: Moody, Psimas, Randall, Smith, Whitehurst, Holley <br />Nays: None <br /> <br />(b) UP-08-17 <br /> <br />DOWNTOWN - Charles Greenhood requests a use permit to <br />operate an entertainment establishment at 467 Court Street. The <br />Comprehensive Plan's Generalized Future Land Use Map <br />recommends mixed use downtown development in this area. Vision <br />Principle: A Robust and Prospering Economy. <br /> <br />There were no speakers. <br /> <br />Motion by Mr. Moody, and seconded by Mr. Whitehurst, to concur with the <br />recommendation of the Planning Commission that UP-08-17 be approved on first <br />reading, and was adopted by the following vote: <br />
