July 9, 1991 <br /> <br />- REPORTS <br /> <br />FROM THE CITY <br /> <br />MANAGER <br /> <br /> 91-243. ~ Letter from the City Manager reeommending~ <br />adoption of an ordinance-appropriating $9,709 from the Capital <br />Improvements Fund for replacement fencing on two ball fields at <br />the Olive Branch facility, and award of the contract to the low <br />bidder, Che~sapeake Fence and Awning Company, Inc. <br /> <br /> ~lhe Director of Leisure Services has requested an <br />appropriatio~for..~enc~repl-acement a-t two ball fields located <br />at the Olive Branch faci-lity. This faci~.~ty has been in <br />continuous use since 1965, with generations of Portsmouth <br />youths using the'-f~a.c~Lity. These fields also host tournaments <br />which attract~o~u%~of-town visitors. Because of their age and <br />safety hazards, the fences should be replaced. This project <br />has been advertis, ed for; bids, and Chesapeake Fence and Awning <br />Company, Inc. is the ~low bidder at' $9,709.. . <br /> <br /> I concur with this request and therefore recommend <br />appropriation of $9,709 from the Capital Improvements Fund, and <br />award of the contract to the low bidder, with your ~pproval, <br />the balance in the Capital Improvements Fund will be <br />$4,618,439." <br /> <br /> Motion of Mr. Epperson and seconded <br />the following ordinance was approved on <br />unanimous vote: <br /> <br /> "AN ORDINANCE TO ~PPROPRIATE $9,709. <br /> IMPROVEMENTS <br /> OLIVE BRANCH <br /> <br /> by Mr. Hawks, <br />first reading, and by <br /> <br />FROM THE CAPITAL <br /> <br />FUND FOR THE REPLACEMENT OF FENCES AT THE <br />LITTLE~ LEAGUE BALLFIELDS." <br /> <br /> 91-244 Letter from the City Manager recommending <br />adoption of an ordinance to amend Chapter 22 of the Code of the <br />City of Portsmouth, Virginia, 1988, by amending Section <br />22-582(b) thereof, pertaining to parking in spaces reserved for <br />handicapped persons. <br /> <br /> Adoption of this ordinance will increase the fine for <br /> illegally parking in handicapped spaces from $25 to <br /> $50 if paid Within eight days. The maximum fine of <br /> $100 for a court conviction will not change. This <br /> action was requested by the Mayor's Committee for <br /> Persons with Disabilities. <br /> <br /> "In May, you considered an ordinance increasing the fine <br />for illegally parking in handicapped spaces. In response to <br />your concerns, my staff met with the Mayor's Committee for <br />Persons with Disabilities to discuss more fully their <br />recommendation. The Committee felt that the existing $25 fine <br />is too low to discourage violations; however, they understood <br />the City ~ounc~l s reluctance to raise the maximum penalty to <br />$250 if a summons is issued. <br /> <br /> Consequently, my recommendation' to you is that the fine be <br /> increased for parking unlawfully in a handicapped space to $50. <br /> If, after eight days, the fine is not paid, a summons would be <br /> issued which would carry a potential fine of up to $100, upon <br /> conviction. The $100 fine is the penalty currently imposed by <br /> City Code. <br /> <br /> I recommend your approval of this ordinance. In order to <br /> allow time to print new tickets, I further recommend that the <br /> ordinance become effective November 1, 1991." <br /> <br /> <br />
