NOVEMBER 14, 2000 <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of <br />Portsmouth, Virginia: <br /> <br />1. That the use for which the permit hereinafter-described is sought: <br /> <br /> (a) Will not adversely affect the health and safety of persons residing or <br />working in the neighborhood of the proposed use; <br /> <br /> (b) Will not be detrimental to the public use or injurious to the property or <br />improvements in the neighborhood; <br /> <br /> (c) Will be provided with sufficient landscaping to insure compatibility with <br />surrounding uses; <br /> <br /> (d) Will be a project that will be developed according to a plan for parking, <br />driveways, and curb cuts which will provide for safe and convenient traffic movement; <br />and <br /> <br /> (e) Will be in accordance with the purposes of the City of Portsmouth Zoning <br />Ordinance. <br /> <br /> 2. That Design Assistance Construction Systems, Inc., is hereby granted a use <br />permit pursuant to Section 40-43.1 of the Code of the City of Portsmouth, Virginia <br />(1988) to manufacture steel roof and floor deck products on property located at in the <br />PortCentre Commerce Park, and being more particularly described as: <br /> <br />UP-99-15 <br /> <br /> Beginning at the northeast corner of Seventh Street and <br />Lincoln Street; thence, in a northerly direction 610'+ to a point; <br />thence, in an easterly direction 480'+ to a point; thence, in a <br />southerly direction 580'+ to a point; thence, in a westerly direction <br />700'+ to a point of the beginning. <br /> <br />3. That the use permit is approved subject to the following conditions: <br /> <br /> (a) The project shall be constructed in accordance with the submitted site <br />plan, identified as Exhibit A and attached hereto. <br /> <br /> (b) The proposed project shall be constructed in accordance with the <br />submitted floor plans, identified as Exhibits B-1 and B-2, and the submitted elevations, <br />identified as Exhibits C-1 and C-2, attached hereto. <br /> <br /> (c) All landscaping shall be established and maintained in accordance with <br />Chapter 36, Article III, of the City Code and Section 40-71.2 of the Zoning Ordinance. <br /> <br /> (d) All activities on the site shall be conducted in compliance with the Section <br />24-255 of the City Code pertaining to noise. <br /> <br /> (e) The facility shall comply with all applicable federal, state, and local codes, <br />ordinances and regulations and the applicant shall obtain and maintain in effect all <br />necessary licenses and permits. <br /> <br /> (f) All taxes and fees in connection with the subject property and operation <br />shall be paid when due. <br /> <br /> 4. REVOCATION OF PERMIT: Violation of any of the above conditions <br />may serve as grounds for revocation of the use permit by the City Council." <br /> <br />Ayes: Benn, Griffin, Moody, Pitts, Whitehurst, Holley <br />Nays: None <br />Abstained: Robinett (Mr. Robinett abstained because of a possible financial conflict of <br />interest due to his employment.) <br /> <br /> <br />
