NOVEMBER 14, 2000 NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia: 1. That the use for which the permit hereinafter-described is sought: (a) Will not adversely affect the health and safety of persons residing or working in the neighborhood of the proposed use; (b) Will not be detrimental to the public use or injurious to the property or improvements in the neighborhood; (c) Will be provided with sufficient landscaping to insure compatibility with surrounding uses; (d) Will be a project that will be developed according to a plan for parking, driveways, and curb cuts which will provide for safe and convenient traffic movement; and (e) Will be in accordance with the purposes of the City of Portsmouth Zoning Ordinance. 2. That Design Assistance Construction Systems, Inc., is hereby granted a use permit pursuant to Section 40-43.1 of the Code of the City of Portsmouth, Virginia (1988) to manufacture steel roof and floor deck products on property located at in the PortCentre Commerce Park, and being more particularly described as: UP-99-15 Beginning at the northeast corner of Seventh Street and Lincoln Street; thence, in a northerly direction 610'+ to a point; thence, in an easterly direction 480'+ to a point; thence, in a southerly direction 580'+ to a point; thence, in a westerly direction 700'+ to a point of the beginning. 3. That the use permit is approved subject to the following conditions: (a) The project shall be constructed in accordance with the submitted site plan, identified as Exhibit A and attached hereto. (b) The proposed project shall be constructed in accordance with the submitted floor plans, identified as Exhibits B-1 and B-2, and the submitted elevations, identified as Exhibits C-1 and C-2, attached hereto. (c) All landscaping shall be established and maintained in accordance with Chapter 36, Article III, of the City Code and Section 40-71.2 of the Zoning Ordinance. (d) All activities on the site shall be conducted in compliance with the Section 24-255 of the City Code pertaining to noise. (e) The facility shall comply with all applicable federal, state, and local codes, ordinances and regulations and the applicant shall obtain and maintain in effect all necessary licenses and permits. (f) All taxes and fees in connection with the subject property and operation shall be paid when due. 4. REVOCATION OF PERMIT: Violation of any of the above conditions may serve as grounds for revocation of the use permit by the City Council."
