June 9. 2008 At a Called Meeting of the City Council on Monday, June 9, 2008, there were present: Mayor James W. Holley III, Vice Mayor Marlene W. Randall, William E. Moody, Jr., Stephen E. Heretick, Elizabeth M. Psi mas, *Ray A. Smith, Sr., *Douglas L. Smith, City Manager Kenneth L. Chandler, City Attorney G. Timothy Oksman. 08 - 266 - The following call for the meeting was read: "Please attend a Called Meeting of the City Council to be held in the 6th Floor Conference Room, 801 Crawford Street, 5:00 p.m., Monday, June 9, 2008 for the purpose of a Public Work Session. In addition, you may consider a motion to go into a Closed Meeting. By order of the Mayor." 08 - 267 - The following item was discussed in Public Work Session: 1. Virginia Department of Transportation Martin Luther King (VDOT MLK) Public Hearing Follow-Up - David Heuer, VDOT Hampton Roads District Administrator 08 - 268 - Motion by Mr. Heretick, and seconded by Ms. Psi mas, to go into Closed Meeting pursuant to provisions of Section 2.2-3711 (A) of the Code of Virginia pursuant to the following legal authorities: subsection 3, the disposition of publicly held real property; and subsection 5, new prospective business or the expansion of an existing business which has not been previously announced. The subject matter of the meeting is development of a publicly held site in the midtown area, and also a business relocation or expansion. The purpose of the meeting is to permit confidential discussion of negotiating strategy. The motion was adopted by unanimous vote. '" Councilman William E. Moody, Jr. was absent during the vote. Motion by Ms. Psi mas, and seconded by Mr. R. Smith, pursuant to Section 2.2- 3712(D) of the Code of Virginia, certifying that to the best of the Council Members' knowledge during the immediately preceding Closed Meeting of the City Council: 1. Only public business matters lawfully exempted from open meeting requirements by the Virginia Freedom of Information Act, and 2. Only such public business matters as were identified in the motion, by which the Closed Meeting was convened, were heard, discussed or considered in the meeting by the City Council. The motion was adopted by unanimous vote.
