<br />June 9. 2008 <br /> <br />At a Called Meeting of the City Council on Monday, June 9, 2008, there were <br />present: <br /> <br />Mayor James W. Holley III, Vice Mayor Marlene W. Randall, William E. Moody, Jr., <br />Stephen E. Heretick, Elizabeth M. Psi mas, *Ray A. Smith, Sr., *Douglas L. Smith, City <br />Manager Kenneth L. Chandler, City Attorney G. Timothy Oksman. <br /> <br />08 - 266 - The following call for the meeting was read: <br /> <br />"Please attend a Called Meeting of the City Council to be held in the 6th Floor <br />Conference Room, 801 Crawford Street, 5:00 p.m., Monday, June 9, 2008 for the <br />purpose of a Public Work Session. <br /> <br />In addition, you may consider a motion to go into a Closed Meeting. <br /> <br />By order of the Mayor." <br /> <br />08 - 267 - The following item was discussed in Public Work Session: <br /> <br />1. Virginia Department of Transportation Martin Luther King (VDOT MLK) Public <br />Hearing Follow-Up - David Heuer, VDOT Hampton Roads District Administrator <br /> <br />08 - 268 - Motion by Mr. Heretick, and seconded by Ms. Psi mas, to go into Closed <br />Meeting pursuant to provisions of Section 2.2-3711 (A) of the Code of Virginia pursuant <br />to the following legal authorities: <br /> <br />subsection 3, the disposition of publicly held real property; and <br /> <br />subsection 5, new prospective business or the expansion of an existing <br />business which has not been previously announced. <br /> <br />The subject matter of the meeting is development of a publicly held site in the <br />midtown area, and also a business relocation or expansion. <br /> <br />The purpose of the meeting is to permit confidential discussion of negotiating <br />strategy. <br /> <br />The motion was adopted by unanimous vote. <br /> <br />'" Councilman William E. Moody, Jr. was absent during the vote. <br /> <br />Motion by Ms. Psi mas, and seconded by Mr. R. Smith, pursuant to Section 2.2- <br />3712(D) of the Code of Virginia, certifying that to the best of the Council Members' <br />knowledge during the immediately preceding Closed Meeting of the City Council: <br /> <br />1. Only public business matters lawfully exempted from open meeting <br />requirements by the Virginia Freedom of Information Act, and <br /> <br />2. Only such public business matters as were identified in the motion, by which <br />the Closed Meeting was convened, were heard, discussed or considered in <br />the meeting by the City Council. <br /> <br />The motion was adopted by unanimous vote. <br />
