<br />April 22. 2008 <br /> <br />(e) Will be In accordance with the purposes of the City of Portsmouth Zoning <br />Ordinance. <br /> <br />2. That Gwendolyn McCoy is hereby granted a use permit pursuant to <br />Section 40-43.1 of the Code of the City of Portsmouth, Virginia (2006) to operate an <br />adult daycare center at 2914 High Street, and being more particularly described as: <br /> <br />UP-08-05 <br /> <br />Beginning at a point 147.5':t from the northwest corner of High Street and Florida <br />Avenue; thence, in a westerly direction 59':t to a point; thence, in a northerly direction <br />113':t to a point; thence, in an easterly direction 59':t to a point; thence, in a southerly <br />direction 113':t to a point of the beginning. <br /> <br />That the use permit is approved subject to the following conditions which shall be <br />observed by the applicant and any successor in interest: <br /> <br />(a) The occupancy shall be limited to no more than twenty (20) clients at any given <br />time. <br /> <br />(b) A site redevelopment plan shall be submitted to the Director of Planning for <br />review and approval. The plan shall address the addition of windows along the <br />building's frontage on High Street and the planting of two (2) shade trees and shrubs. <br /> <br />(c) The applicant shall provide a minimum of four (4) parking spaces with a turn- <br />around area to the rear of the property, as approved by the City Engineer. A parking <br />sign shall be erected denoting that parking is solely for the facility. <br /> <br />(d) The owner/developer shall be responsible for upgrades to water and sewer, as <br />necessary, including the installation of a backflow preventer device approved by the <br />Public Utilities Department. <br /> <br />(e) The applicant shall comply with a trash plan approved by General Services. A <br />dumpster is not permitted for use on the premises. <br /> <br />(f) The proposed business shall operate in accordance with federal, state and local <br />regulations. <br /> <br />(g) All taxes and fees in connection with the proposed use shall be paid when due. <br /> <br />(a) The applicant shall comply with all applicable codes, ordinances and regulations <br />of federal, state and local governments and shall obtain and maintain in effect all <br />necessary licenses and permits. <br /> <br />(h) No vehicles shall be stored on-site. <br /> <br />4. REVOCATION OF PERMIT: Violation of any of the above conditions may <br />serve as grounds for revocation of the use permit by the City Council." <br /> <br />Ayes: Heretick, Moody, Psi mas, Randall, D. Smith, R. Smith, Holley <br />Nays: None <br /> <br />Motion by Ms. Randall, and seconded by Mr. Moody, to adopt the following <br />resolution approved on first reading at the April 8, 2008 meeting, and was adopted by <br />the following vote: <br /> <br />08-187 (b): <br /> <br />"RESOLUTION GRANTING A USE PERMIT (UP-08-06) TO INTEGRATED LIVING <br />COMMUNITIES OF PORTSMOUTH, L.L.C., TO EXPAND AN EXISTING ASSISTED <br />LIVING FACILITY LOCATED AT 4916 WEST NORFOLK ROAD AND 3911 CEDAR <br />LANE ONTO A PORTION OF 4908 WEST NORFOLK ROAD. <br />
