<br />At a Regular Meeting of the City Council on Tuesday, March 25, 2008, there
<br />were present:
<br />
<br />Mayor James W. Holley III, Vice Mayor Marlene W. Randall, William E. Moody, Jr.,
<br />Stephen E. Heretick, Elizabeth M. Psi mas, Ray A. Smith, Sr., Douglas L. Smith, City
<br />Manager Kenneth L. Chandler, City Attorney G. Timothy Oksman.
<br />
<br />Councilman Ray A. Smith, Sr. opened the meeting with prayer, which was
<br />followed by the Pledge of Allegiance to the Flag.
<br />
<br />Mayor Holley called the meeting to order and welcomed all in attendance.
<br />
<br />Motion by Mr. Moody, and seconded by Mr. D. Smith, to approve the minutes of
<br />a Called Meeting of March 10, 2008, a Called Meeting of March 11, 2008, and a
<br />Regular Meeting of March 11,2008, and was adopted by the following vote:
<br />
<br />Ayes: Heretick, Moody, Psi mas, Randall, D. Smith, R. Smith, Holley
<br />Nays: None
<br />
<br />- Public Hearing -
<br />

<br />
<br />Public hearing on granting an ordinance cable franchise to Cavalier IPTV,
<br />LLC that would authorize them to begin offering cable service in the City of
<br />Portsmouth.
<br />
<br />. G. Timothy Oksman, City Attorney, gave an overview of the proposed ordinance.
<br />
<br />1. Mark Geduldig-Yatrofsky, 363 Middle Street, spoke in support of this item.

<br />- Unfinished Business -
<br />
<br />08 - 129 - Rezoning and use permit:
<br />
<br />Motion by Mr. Heretick, and seconded by Mr. R. Smith, to adopt the following
<br />ordinance approved on first reading at the March 11, 2008 meeting, and was adopted
<br />by the following vote:
<br />
<br />08-129 (a):
<br />"ZONING AMENDMENT ORDINANCE Z-08-02."

<br />Motion by Ms. Psimas, and seconded by Ms. Randall, to adopt the following
<br />resolution approved on first reading at the March 11, 2008 meeting, and was adopted
<br />by the following vote:

<br />"RESOLUTION GRANTING A USE PERMIT (UP-08-04) TO STILL, INC., TO
<br />OPERATE A RESTAURANT AT 4508 COURT STREET.
<br />
<br />WHEREAS, Still, Inc., has made application pursuant to Section 40-43.1 of the
<br />Code of the City of Portsmouth, Virginia (2006) for the granting of a use permit for the
<br />operation of a restaurant at 450B Court Street, Portsmouth, Virginia; and
<br />
<br />WHEREAS, the applicant and the Planning Director have done all things
<br />required to be done in connection with said application; and
<br />
