<br />specified to compensate the owners of the property designated and
<br />shown as "Plat Showing Property To Be Acquired From Steven C. Reed
<br />and Dep T. Reed For Right-of-way Purposes," made by Engineering
<br />Services, Inc., Civil Engineering-Land Surveying, dated July 17,
<br />1991, a copy of which plat is attached hereto and made a part
<br />hereof.

<br /> The name of the property owners are Steven C. Reed and Dep T.
<br />Reed.
<br />
<br /> The amount to be deposited t~ the credit of the Clerk of the
<br />Circuit Court of the City of Portsmouth is $t00.00."

<br /> (E) Motion of Mr. Clemons and seconded by Mr. Epperson, the
<br />following ~esolution was a~opted and by the following vote:

<br />"A RESOLUTION TO PROVIDE FOR THE ACQUISITION OF CERTAIN
<br />PROPERTY OWNED BY MELVIN SHELTON WOODARD UNDER EMINENT
<br />DOMAIN PROCEEDINGS PURSUANT TO THE CHARTER OF THE CITY OF
<br />PORTSMOUTH, SAID PROPERTY BEING NECESSARY FOR THE WIDENING
<br />IN THE HIGH STREET/SHIRLEY ROAD PROJECT.
<br />
<br /> WHEREAS, the Council of the City of
<br />it to be in the public interest to widen
<br />Street/Shirley Road Project; and
<br />
<br />Portsmouth has determined
<br />High Street in the High
<br />
<br /> WHEREAS, the City has not been able to purchase th~ property
<br />described herein, necessary to the project, because the owner
<br />thereof and the City have nor been able to agree upon %he price to
<br />be paid therefor; and
<br />
<br /> WHEREAS, the advancement of the work and the use o~ said
<br />property will be unreasonably delayed if said property is not made
<br />available for the project as soon as possible.

<br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of
<br />Portsmouth, Virginia:

<br /> That the City Attorney be, and he hereby is, directed to
<br />institute eminent domain proceedings against the
<br />hereinafter-described property situate in the City of Portsmouth,
<br />Vir§inla, for the purpose of acquiring the fee simple title
<br />thereto pursuanz to Sections 2.06, 2.07 and 2.08 of the Charter of
<br />the City of Portsmouth, Virgini~a, as amended, and to deposit to
<br />the credit of the Clerk of the ~ircuit Court of the City of
<br />Portsmouth, as provided by law, the sum hereinafter spedified to
<br />compensate the owner of the property designated and sho~n as "Plat
<br />Showing Property To Be Acquired From Melvin ~Shelton Woodard For
<br />Right-of-way Purposes, made by Engineering ~ervices, I~c., Civil
<br />Engineering-Land Surveying, dated July 17, 1991, a copy of which
<br />plat is attached hereto and made a part hereof.
<br />
<br /> The name of the property owner is Melvin Shelton Wcodard.
<br />
<br /> The amount to be deposited to the credit of the Clerk of the
<br />Circuit Court of the City of Portsmouth is $1,600.00."
