<br />At a Regular Meeting of the City Council on Tuesday, February 12, 2008, there
<br />were present:
<br />
<br />Mayor James Holley III, Vice Mayor Marlene W. Randall, William E. Moody, Jr.,
<br />Stephen E. Heretick, Elizabeth M. Psimas, Ray A. Smith, Sr., Douglas L. Smith, City
<br />Manager Kenneth L. Chandler, City Attorney G. Timothy Oksman.
<br />
<br />Reverend Dr. John O. Agbaje opened the meeting with prayer, which was
<br />followed by the Pledge of Allegiance to the Flag.
<br />
<br />Mayor Holley called the meeting to order and welcomed all in attendance.
<br />
<br />Motion by Mr. Moody, and seconded by Mr. D. Smith, to approve the minutes of
<br />a Called Meeting on January 22,2008, a Regular Meeting of January 22, 2008, a Called
<br />Meeting of January 28, 2008, a Called Meeting of January 31, 2008, and a Called
<br />Meeting of February 4,2008 and was adopted by the following vote:

<br />Nays: None

<br />08 - 70 - Presentations:
<br />
<br />. Presentation of LivCom Award to the City of Portsmouth.
<br />
<br />. Presentation of special lapel pins to newly appointed Board and Commission
<br />members.
<br />
<br />Motion by Mr. R. Smith, and seconded by Ms. Psi mas, changing the order of
<br />business to consider Item 08-78, under City Manager's Report, at the beginning of the
<br />agenda, and was adopted by the following vote:

<br />Nays: None
<br />
<br />08 - 78 - Adoption of an ordinance authorizing a Memorandum of Understanding with
<br />Todifest, Inc. to include an Arts Stability Adjustment for two quarterly disbursements of
<br />$86,667 in January and April 2008 for a total of $173,334. Vision Principle: Thriving
<br />Neighborhood and a Sense of Community.
<br />
<br />Motion by Ms. Psimas, and seconded by Mr. Moody, to withdraw item 08-78
<br />from the agenda, and was adopted by the following vote:

<br />- Public Hearing -
<br />
<br />08-71 Public hearing to receive public comments concerning a proposed
<br />amendment to Section 17-83 of Division 3 of Chapter 17 of the Code of
<br />the City of Portsmouth, pertaining to Rental Inspections to provide that it
<br />shall be a misdemeanor to lease or rent a residential rental unit without an
<br />inspection and issuance of a Certificate of Compliance.

<br />
<br />2. Martha Ann Creecy, 317 Dinwiddie Street, spoke in support of this item.
