City is installing fiber optic lines <br />throughout the city which necessitate switching equipment; and <br /> <br /> WHEREAS, River Pointe Parkway offers the best location fOr <br />the necessary switching equipment i:n the area now being <br />upgraded; and <br /> <br /> WHEREAS, the Council of the City of Portsmouth, virginia, <br />deems it to be in the best interest of the City to permit <br />Chesapeake and Potomac Telephone Company of Virginia to use a <br />portion of the right-of-way of River Pointe Parkway fQr this <br />purpose. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City <br />of Portsmouth, Virginia, that the City Manager be, and he <br />hereby is, authorized to exeCute a permit to Chesapeake and <br />Potomac Telephone Company of virginia on property of the City <br />of Portsmouth, Virginia, more particularly described by that <br />certain exhibit e~titled "Exhibit 'A' showing C&P Telephone <br />Company Fiber Optic Hut Right-Of-Way EncrOachment Area site Df <br />Existing Pump Station ~57 Located at River Pointe Parkway,. <br />Portsmouth, Virginia (Reference: D.B. 962, P. 578)" dated <br />February 17, 1992, prepared by Horton & Dodd~ P.C, Su~usyors, <br />Engineers & Planners, Chesapeake, Virginia, attached he'reto and <br />made a part hereoft subject to such conditions as the City <br />Manager shall deem to b~ in the best interest of the Cityl, <br /> <br />Ayes: Clemons, Corprew, Epperson, King, Webb <br />Nays: None <br /> <br />92-138 - Letter from the City Manager recommending adoption of <br />a resolution authorizing the City Manager to submit an <br />application for a Chesapeake Bay Local Assistance Department <br />Grant to offset costs of complying with the Chesapeake Bay <br />Preservation Act~ and to sign all documents related to the <br />grant. <br /> <br /> "In fiscal year 1992-93, $750,000 in State grant <br />assistance is available for communities subject to the <br />Chesapeake Bay Preservation Act. These funds are available on <br />a competitive basis. The State will fund 50% of a locality's <br />Bay Act related work program. In-kind matching services <br />(staff time and expenses) will be provided by the planning <br />staff. No cash outlay will be required, i <br /> <br /> Currently, the City has a grant-funded plan~er under the <br />FY 91-92 Chesapeake Bay Act grant. He is responsible for <br />making sure the City is in compliance with the Chesapeake Bay <br />Act enabling legislation and assists the public with related <br />Bay Act information <br /> <br /> Continued compliance with the Chesapeake Bay Act will <br />require further adjustment in the City's development review <br />procedures, ordinances and Comprehensive Plan. These grant <br />funds will extend the planner position and allow for production <br />of public service announcements and other informational <br />materials. I recommend approval of a resolution authorizing me <br />to submit an application and sign all necessary do~cuments <br />related to the grant." <br /> <br /> Motion of Mr. Clemons and seconded by Mr. King, the <br />following resolution was adopted on first and final reading and <br />by the following vote: <br /> <br /> "A RESOLUTION AUTHORIZING THE CITY MANAGER TO SUBMIT AN <br />APPLICATION FOR A CHESAPEAKE BAY LOCAL ASSISTANCE DEPARTMENT <br />GRANT TO OFFSET COSTS OF COMPLYING WITH THE CHESAPEAKE BAY <br />PRESERVATION ACT. <br /> <br /> <br />
