<br />November 27,2007 <br /> <br />Discussion: <br />. While the recent Supreme Court decision took away the power of the federal <br />courts on this issue, both Congress and the Virginia General Assembly could still enact <br />legislation restricting or making illegal flow control ordinances. <br />. SPSA recommends that its member localities act quickly to enact flow control <br />ordinances before the General Assembly convenes and possibly restricts their ability to <br />do so. <br />. Flow control does not restrict the ability of private haulers to collect solid waste. It <br />merely requires them to dispose of it at a designated publicly owned landfill. <br />. With flow control in place, SPSA can continue to payoff all its debt by 2018 <br />without increasing the tipping rates to members beyond the current $100 per ton rate. <br />. In order to enact flow control, localities must hold a public hearing and make <br />several findings regarding existing disposal facilities. <br />. Once enacted, flow control will equalize the disposal rate paid by members and <br />private trash haulers. The equalization will reduce the Portsmouth municipal solid waste <br />tipping fee by 25% to 50%. <br />. To date, Norfolk, Isle of Wight County, and Southampton County have adopted <br />flow control. <br /> <br />Financial Impact: <br />. There is no revenue or cost increase to the City of Portsmouth. Lower tipping <br />fee rates set by SPSA for its member communities will result in lower municipal solid <br />waste rates, established through the budget process by City Council and are then <br />passed through as savings to the City's enterprise fund for solid waste. <br /> <br />Recommendation: <br />Adoption of proposed ordinance. Vision Principle: Thriving Neighborhoods and a Sense <br />of Community. <br /> <br />Next Steps: <br />1. Remaining member communities must adopt a similar flow control ordinance - <br />Chesapeake, Suffolk, Franklin and Virginia Beach. <br />2. Once all members enact this form of ordinance, SPSA will notify private haulers <br />of this change in regional policy with flow control becoming effective in the FY 2010 <br />budget (12 months later) <br /> <br />Motion by Mr. R. Smith, to adopt the following <br />ordinance, and was adopted by the following vote: <br /> <br />"ORDINANCE TO AMEND CHAPTER 16 OF THE CODE OF THE CITY OF <br />PORTSMOUTH (2006) TO REGULATE THE COLLECTION AND DISPOSAL OF <br />SOLID WASTE." <br /> <br />Ayes: Heretick, Moody, Psi mas, D.
