May 26, 1992 WHEREAS, the Council of the~'city of Portsmouth, Virginia,~ has determined it to be in the public interest to widen High Street. i.n the High Street Widening Halifax Avenue to Hartford Street Project; and WHEREAS~ the City_has not been able to purchase the property d~scr~ibed!iherein, necessary ~to the project;~ because the owners thereof and the City have not been able to agree upon the price to be paid therefore; and WHEREAS, the advancement ofi th~ work ~and the use of said proper£y~willi~be un~ea~sDnably de~lay~d if said property is not~ made available for the project as soon as poSsible. ~ _,~ ~ ~ ~ NOW, THEREFORE, BE IT RESOLVED by ~the Council of the City of Portsmouth, Virginia: That the City Attorney be, and he hereby is, directed to institute Eminent Domain proceedings against the herei~qafter~-described property situate in ~the City of Portsmouth, Virginia, for the purpose of acquiring fee simple title thereto Pursuant~ to Sections 2.06~, 2.07, and 2..08 of th~ Code, and to deposit to the credit of the Clerk of the Circuit Court of the City~ of PortsmOuth as provided by lawl the sum hereinafter specified to compensate the owners of the property designated and shown as "Plat showing parcel owned by Donald E. & Ethel .L.~ Wagner~ to be~ Acquired by~ City o_f PortSmouth, Virginia, High Street Improvements , R/W a~quisition,, mad~ by Hassel~l & Folkes, P~C., Engineers, Surveyors & Planners, dated March 22, 1989,~ a copy of which~pl-at is attached hereto and~ made a par~ hereof. ~ ~ The names of the property o~ners are Donald E. Wagner and Ethel [~. Wagner.. The amount to be deposited to the credit of the Clerk ~f the Circuit Court of the City of Portsmouth is $3,930.00. Ayes: -CLemons, Corprew, Epperson, King, Hawks Nays: none . (c) A resolution to provide for the acquisition of certain property owned by Apolinar H. Antonion and ~Remedios A. Antonion under eminent domain proceedings pursuant t~ the Cha~ter of the City of Portsmouth. Motion of Mr. Hawks and seconded by Mr. Clemons, ~he following resolution was adopted and by the following vote: "A RESOLU~TION TO PROVIDE FOR.THE ACQUISITION OF CERTA%N PROPERTY~OWNED BY. APOLINAR H. ANTONION AND REMEDIOS A.
