WHEREAS, P~stor Arthur J. B~rm~, oh'behalf of the Tabernacle of Deliverance of Our Lord Jes~s Christ, has made application pursuan~ to Section 40-43.1 of the Code of the City of Portsmouth, Virginia~, 1988, for granting~of a use permit to operate a church at 5017-5021 George Washington Highway, Portsmouth, Virginia; and ~'~ WHEREAS, the applicant and the Planning Director have all thin~s~required to be done in connection with said applicatiDn; ~nd WHEREAS, the Planning Commission has recommended the granting of said use permit, with conditions. done NOW~'THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia: 1. That the use for which the use permit hereinafter described~is sought: (a) will not adversely affect the health and safety of persons residi~ng or Working ~n the neighborh6od of the proposed use; (b) Wil2' n6t. be de~trimental to the~ public Use or injuriou~ to the property or improvements in the neighborhood; ~ (c) Will be provided with sufficient landscaping to insure compatibility 'with surrounding uses; (d) Will be a project that will be developed according to a plan qor parking, driveways, and curb chis which will provide for safe and convenient traffic movement; and (e) Will be in accordance with the purposes of the City of Portsmouth Zoning Ordinance. 2. That the Tabernacle of Deliverance of Our Lord Jesus Christ is hereby granted a use permit p~rsuant to Section 40-43.1 Of the Code of the City of Portsmouth, Virginia, 1988, to operate a church at 5017-5021 George Washington Highway, said property being more particularly described as follows:
