<br /> That the City Attorney be, and he hereby is, directed to
<br />institute Eminent Domain proceedings against the
<br />hereinafter-described property situate in the City of
<br />Portsmouth, Virginia, for the purpose of acquiring fee simple
<br />title thereto pursuant to Sections 2.06, 2.07, and 2.08 of the
<br />Code, and to deposit to the credit of the Clerk of the Circuit
<br />Court of the City of Portsmouth as provided~by law the sum
<br />hereinafter specified to compensate the owner of the prope'rt¥
<br />designated and shown as "Plat showing parcel owned by Charles
<br />O. watters to be Acquire~ by City of Portsmouth, Virginia, High
<br />Street Improvements R/W acquisition," made by Ha~se~l &
<br />Folkes, P.C., Engineers, Surveyors & Planners, dated March 22,
<br />1989, a' c~py of which plat is attached her~eto and ma~d~ ~ part
<br />hereof.
<br />
<br /> The name of the property owner is Charles O. Watters.
<br />
<br /> The amount to be deposited to the credit of the Clerk of
<br />the Circuit Court of the City of Portsmouth is $1,760.00.

<br />A resolution to provide for the acquisition of
<br />~ertain property owned by Norman J. Kozak and
<br />Lillian T. Kozak under eminent domain proceedings
<br />pursuant to the Charter of the City of Portsmouth.

<br /> Motion of Mr. Clemons and seconded by Mr. Hawks, the
<br />following resolution was adopted and by the following vote:
<br />
<br /> "A RESOLUTION TO PROVIDE FOR THE ACQUISITION OF CERTAIN
<br /> PROPERTY OWNED BY NORMAN J. KOZAK AND LILLIAN T. KOZAK
<br /> UNDER EMINENT DOMAIN PROCEEDINGS PURSUANT TO THE CHARTER
<br /> OF THE CITY OF PORTSMOUTH, SAID PROPERTY BEING NECESSARY
<br /> TO WIDEN HIGH STREET IN THE HIGH STREET WIDENING HALIFAX
<br /> AVEN~E~T.O HARTFORD STREET PROJECT.

<br /> WHEREAS, the~Council of the City,of i~rtsmouth, Virginia,
<br />has determined it to be in the public 'interest to widen High
<br />Street in the High Street Widening Halifax Avenue to Hartford
<br />Street Project; a~d
<br />
<br /> WHEREAS, the City has not been able to purchase the
<br />property deScribed herein, necessary to the project, because
<br />the owners thereof and the City have not been able to agree
<br />upon the price to be Paid therefore; and
<br />
<br /> WHEREAS~ ~he advancement of the work and the use' of said
<br />property will be unreasonably delayed if said property is not
<br />made available for the project as soon as possible.

<br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the-City
<br />of Portsmouth, Virginia:
