<br /> "A REsOlUTION TO PROVIDE FOR THE ACQUISITION OF A PERMANENT
<br />AND TEMPORAR~ EASEMENT FOR CONSTRUCTION UPON PROPERTY OWNED BY U &
<br />U ASSOCIATES~ A VIRGINIA GENERAL PARTNERSHIP UNDER EMINENT DOMAIN
<br />PROCEEDINGS ~URSUANT TO THE CHARTER OF THE CITY OF PORTSMOUTH,
<br />VIRGINIA, :SA~D EASEMENTS BEING NECESSARY F~OR THE CONSTRUCTION OF A
<br />WATER TRANSMISSION LINE.

<br /> e City of Portsmouth determined that there is a
<br /> ity that a new water transmission line be constructed
<br /> r plant in the City of Suffolk to the City of

<br /> such construction makes necessary the acquisition of
<br /> temporary construction easements upon property
<br /> de its boundaries in the City of Suffolk, Virginia;
<br />
<br /> WHEREAS the City has not been able to purchase the easements
<br />described he 'ein necessary to the project, because the owner of
<br />the property to be affected by said easements and the City have
<br />not been abl~ to agree upon the price to be paid therefore; and
<br />
<br /> WHEREAS. the a~vancement 0f the:work and the use of said
<br />property wil~ be unreasonably delayed if said easements are not
<br />made available fOr the project as soon as possible.

<br />~ City Attorney be, and he hereby is, authorized and
<br />~ave instituted eminent domain prOceedings against the
<br />lescribed property situate in the City of Suffolk,
<br />7 the purpose of acquiring a permanent and temporary
<br />easement for construction of a water transmission
<br />~ to Sections 2.06, 2.07, and 2.08 of the Charter of
<br />~ortsm°Uth, Virginia, as amended, and to deposit to
<br />[ the Clerk of the Circuit Court of the City of
<br />iinia, as provided by law, the sum hereinafter
<br />compensate the Owner of the property designated and
<br /> certain plat entitled "Plat Showing Utility Easement
<br />~d From U & U Associates, a Virginia General
<br />~y The City Of Portsmouth, Virginia, Sleepy Hole
<br />[folk, Virginia," dated January 15, 1992, prepared by
<br />Associates, LTD., Surveyors, Engineers, Planners, a
