' 405 ' JUne 23 1992 That th~ City Attorney be, and he hereby is, authorized and directed to ~ave instituted eminent domain proceedings against the hereinafter-~escribed property situate in the City of Suffolk, Virginia, fo~ the purpose of acquiring a temporary construction easement for construction of a water transmission line pursuant to Sections 2.0~i, 2.07, and 2.08 of the Charter of the City of Portsmouth; ~irginia, as amended, and to deposit to the credit of the Clerk of the Circuit Court of the City of Suffolk, Virginia, as provided ,y law, the sum hereinafter specified to compensate the owner of the property designated and shown on that certain plat entitle~l "Plat Showing UtititY Easement To Be Acquired From Holland Inve!~tment & Manufacturing Corporation By The City Of Portsmouth, ~irginia, Sleepy Hole Borough - Suffolk, Virginia" dated januar~ 15, 1992, prepared by Rouse-Sirine Associates, LTD., Surveyors, E~tgineers, Planners, a copy of which said plat is attached~her~to and made a part,hereof. The namer of the property owner is Holland Investment & Manufacturin(i Corporation'% The amc nt to be deposited to the Credit of the Clerk of the Circuit Cour~ of the City of Suffolk is $800.00." Motion ~f ~r. Clemens, Seconded by Mr. EpperSon, the following re:llolution was adopted on first and final reading and by the followin~ vote: "A RESO] JTION TO PROVIDE FOR THE ACQUISITION OF A PERMANENT AND TEMPORAR~ EASEMENT FOR CONSTRUCTION UPON PROPERTY OWNED BY KIRK TIMBER ~D FARMING COMPANY UNDER EMINENT DOMAIN PROCEEDINGS PURSUANT TO 7HE CHARTER OF THE CITY OF PORTSMOUTH, VIRGINIA, SAID EASEMENTS BEING NECESSARY FOR THE CONSTRUCTION OF A WATER TRANSMISSION LINE. WHEREAS by a resolution adopted on April 28, 1992, the Council of tire City of Portsmouth determined that there is a public neces~ity that a new water transmission line be constructed from its wat~r plant in the City of Suffolk to the City of Portsmouth; .nd WHEREAS such construction makes necessary the acquisition of permanent an~ temporary construction easements upon property located outside its boundarieS in the City of Suffolk, Virginia; and / WHEREAS~ the City has not ~een able to purchase the easements described herein necessary to the Project, becaUse the owner of the property not been abl~ WHEREAS property wil! made availab~ to be affected by said easements and the City have to agree upon the price to be paid therefore; and the advancement of the work and the use of said · be unreasonably delayed if said easements are not e for the project as soon as possible.
