<br />AUQust 28. 2007 <br /> <br />(g) The project complies with the standards for approval of a use permit set forth in <br />Section 40-106 of the Code of the City of Portsmouth, Virginia (2006); and <br /> <br />(h) The project provides parking, building access and pathways for persons with <br />disabilities in accordance with the requirements of the Americans with Disabilities Act. <br /> <br />2. That a housing use permit for the construction of 39 single-family and 34 <br />duplex residential units at 1501 King Street, 610 Twine Avenue, 116 County Street, 700 <br />Godwin Street, and 925 Godwin Street is hereby granted to the Portsmouth <br />Redevelopment and Housing Authority subject to the following terms and conditions that <br />shall be observed by the applicant and any successor in interest: <br /> <br />(a) The group housing project shall be limited to 107 units. <br /> <br />(b) No units shall have front doors facing outwards towards an alley. <br /> <br />(c) The design and rights-of-way of the alleys fronting lots 87-99 will be increased so <br />that they can be dedicated as minor streets. <br /> <br />(d) King Street will be widened to a width of thirty paved feet with fifty feet of right-of- <br />way in order to be in compliance with City standards. <br /> <br />(e) The applicant shall construct the units in accordance with the submitted floor <br />plans and building materials. The Director of Planning and Zoning may approve minor <br />modifications. <br /> <br />(f) Each property will meet the Tree Canopy coverage requirements of the city code <br />when their site plans are submitted. <br /> <br />(g) The completion of a Solid Waste Management Plan and a plan for the placement <br />of garbage cans shall be submitted to and approved by the Department of General <br />Services. <br /> <br />(h) The project shall be constructed in accordance with all applicable codes, <br />ordinances, and regulations of federal, state, and local governments. <br /> <br />(i) The applicant shall obtain all required licenses and permits before operation and <br />these licenses and permits shall remain in effect during the development of the project. <br /> <br />3. EXPIRATION OF PERMIT: Unless extended as provided under Section <br />40-115 of the Code of the City of Portsmouth, Virginia (2006), the housing use permit <br />shall expire for any portion of the approved project for which building permits have not <br />been issued if the applicant fails to apply for all building permits for the entire project <br />within one year of the adoption of this resolution. <br /> <br />4. REVOCATION OF PERMIT: Violation of any of the above conditions may <br />serve as grounds for revocation of the permit by the City Council." <br /> <br />Ayes: Heretick, Moody, Psi mas, R. Smith, D. Smith, Holley <br />Nays: None <br /> <br />Motion by Ms. Psi mas, and seconded by Mr. Heretick, to adopt the following <br />resolution approved on first reading at the August 14, 2007 meeting, and was adopted <br />by the following vote: <br /> <br />07 -345 (c): <br /> <br />"RESOLUTION GRANTING A USE PERMIT (UP- 07-15) TO ANDREW FORYSIAK <br />TO OPERATE A RESTAURANT AT 619 HIGH STREET. <br />
