<br />At a Regular Meeting of the City Council on Tuesday, August 28, 2007, there
<br />were present:
<br />
<br />Mayor James W. Holley III, William E. Moody, Jr., Stephen E. Heretick, Elizabeth M.
<br />Psi mas, Ray A. Smith, Sr., Douglas L. Smith, City Manager Kenneth L. Chandler, City
<br />Attorney G. Timothy Oksman.
<br />
<br />Reverend Robert Lee opened the meeting with prayer, which was followed by the
<br />Pledge of Allegiance to the Flag.
<br />
<br />Mayor Holley called the meeting to order and welcomed all in attendance.
<br />
<br />Motion by Ms. Psimas, and seconded by Mr. D. Smith, to approve the minutes of
<br />a Called Meeting on August 13, 2007, of a Called Meeting on August 14, 2007, and of a
<br />Regular Meeting on August 14, 2007, and was adopted by the following vote:
<br />
<br />Ayes: Heretick, Moody, Psi mas, D. Smith, R. Smith, Holley
<br />Nays: None
<br />
<br />. Sheriff William Watson thanked members of Council for riding along with members
<br />of the Sheriff's Department and presented them with pins as a show of his
<br />appreciation.
<br />
<br />- Public Hearing -
<br />
<br />07 - 366 - Use permit application:
<br />
<br />(a) UP-07-18
<br />
<br />OLDE TOWNE - Portsmouth SB, LLC requests a use permit to
<br />operate an eating establishment at 361 Effingham Street. Vision
<br />Principle: A Robust and Prospering Economy.
<br />
<br />'" Mr. D. Smith informed Council and citizens that his brother IS involved In the
<br />development of this project.
<br />
<br />1. Gary Haste, 3303 Airline Boulevard, spoke in support of this item.
<br />
<br />Motion by Mr. Moody, and seconded by Ms. Psimas, to concur with the
<br />recommendation of the Planning Commission that UP-07-18 be approved on first
<br />reading, and was adopted by the following vote:

<br />Ayes: Heretick, Moody, Psi mas, R. Smith, D. Smith, Holley
<br />Nays: None
<br />
<br />- Unfinished Business -

<br />07 - 345 - Rezoning, housing permit, use permit and code amendment:

<br />Motion by Mr. Heretick, and seconded by Mr. D. Smith, to adopt the following
<br />ordinance approved on first reading at the August 14, 2007 meeting, and was adopted
<br />by the following vote:
<br />
<br />07-345 (a):
<br />"ZONING AMENDMENT ORDINANCE Z-07-10."

<br />
<br />Motion by Mr. R. Smith, and seconded by Mr. D. Smith, to adopt the following
<br />resolution approved on first reading at the August 14, 2007 meeting, and was adopted
