<br />July 24. 2007 <br /> <br />(c) Site development shall comply with all applicable proffers approved In <br />conjunction with the Rezoning Application Z-03-18. <br /> <br />(d) The applicant shall comply with all applicable codes, ordinances and regulations <br />of federal, state and local governments and shall obtain all necessary licenses and <br />permits. <br /> <br />(e) Existing streets shall be closed prior to building permits being issued for this <br />project. <br /> <br />(f) Taxes and fees associated with the property shall be paid when due. <br /> <br />3. EXPIRATION OF PERMIT: Unless an extension is granted as provided <br />under Section 40-49(g) of the Code of the City of Portsmouth, Virginia (2006), the <br />housing use permit shall expire for any portion of the approved project which is not <br />constructed within ten years of the adoption of this resolution. <br /> <br />4. REVOCATION OF PERMIT: Violation of any of the above conditions may <br />serve as grounds for revocation of the permit by the City Council." <br /> <br />Ayes: Heretick, Moody, Psi mas, Randall, D. Smith, Holley <br />Nays: None <br /> <br />Motion by Ms. Psi mas, and seconded by Mr. Heretick, to adopt the following <br />resolution approved on first reading at the July 10, 2007 meeting, and was adopted by <br />the following vote: <br /> <br />07 -312 (g): <br /> <br />"RESOLUTION GRANTING APPROVAL OF A HOUSING USE PERMIT (HP-07-07) <br />TO GEE'S GROUP DEVELOPMENT CORPORATION TO CONSTRUCT 147 SINGLE- <br />FAMILY AND DUPLEX-STYLE RESIDENTIAL CONDOMINIUM UNITS AT THE <br />CORNER OF RIVER POINTE PARKWAY AND WEST NORFOLK ROAD. <br /> <br />WHEREAS, Gee's Group Development Corporation, pursuant to Section 40-112 <br />of the Code of the City of Portsmouth, Virginia (2006), as amended, has made <br />application for the granting of a housing use permit (HP-07 -07) to construct 147 single- <br />family and duplex style condominium units at the corner of River Pointe Parkway and <br />West Norfolk Road, Portsmouth, Virginia; and <br /> <br />WHEREAS, the subject property is furthermore described as: <br /> <br />HP-07-07 <br /> <br />All that certain lot, piece or parcel of land, with the buildings and improvements thereon, <br />lying, situate and being in the City of Portsmouth, Virginia, and designated as FUTURE <br />RESERVE PARCEL 38 983,950 SQ.
