July 24. 2007 (c) Site development shall comply with all applicable proffers approved In conjunction with the Rezoning Application Z-03-18. (d) The applicant shall comply with all applicable codes, ordinances and regulations of federal, state and local governments and shall obtain all necessary licenses and permits. (e) Existing streets shall be closed prior to building permits being issued for this project. (f) Taxes and fees associated with the property shall be paid when due. 3. EXPIRATION OF PERMIT: Unless an extension is granted as provided under Section 40-49(g) of the Code of the City of Portsmouth, Virginia (2006), the housing use permit shall expire for any portion of the approved project which is not constructed within ten years of the adoption of this resolution. 4. REVOCATION OF PERMIT: Violation of any of the above conditions may serve as grounds for revocation of the permit by the City Council." Ayes: Heretick, Moody, Psi mas, Randall, D. Smith, R. Smith, Holley Nays: None Motion by Ms. Psi mas, and seconded by Mr. Heretick, to adopt the following resolution approved on first reading at the July 10, 2007 meeting, and was adopted by the following vote: 07 -312 (g): "RESOLUTION GRANTING APPROVAL OF A HOUSING USE PERMIT (HP-07-07) TO GEE'S GROUP DEVELOPMENT CORPORATION TO CONSTRUCT 147 SINGLE- FAMILY AND DUPLEX-STYLE RESIDENTIAL CONDOMINIUM UNITS AT THE CORNER OF RIVER POINTE PARKWAY AND WEST NORFOLK ROAD. WHEREAS, Gee's Group Development Corporation, pursuant to Section 40-112 of the Code of the City of Portsmouth, Virginia (2006), as amended, has made application for the granting of a housing use permit (HP-07 -07) to construct 147 single- family and duplex style condominium units at the corner of River Pointe Parkway and West Norfolk Road, Portsmouth, Virginia; and WHEREAS, the subject property is furthermore described as: HP-07-07 All that certain lot, piece or parcel of land, with the buildings and improvements thereon, lying, situate and being in the City of Portsmouth, Virginia, and designated as FUTURE RESERVE PARCEL 38 983,950 SQ. FT. OR 22.59 AC. as shown on that certain plat entitled "MAJOR UBDIVISION OF THE ESTATES AT RIVER POINTE AS SHOWN ON M.B. 13 PG. 140 & M.B. 15 PG. 50 PORTSMOUTH, VIRGINIA", dated December 17, 2002 by Woolpert LLP, which said plat is duly recorded in the Clerk's Office of the Circuit Court of the City of Portsmouth, Virginia in Map Book 19 at pages 111-114. IT BEING the same property conveyed to Grantor herein by Deed dated March 13, 2003 and recorded in Clerk's Office of the Circuit Court of the City of Portsmouth, Virginia, as Instrument No. 030043470 and corrected by Deed of Correction dated April 24, 2003 and recorded in the aforesaid Clerk's Office. and
