<br />July 24. 2007 <br /> <br />(j) The applicant shall obtain all required licenses and permits before operation, and <br />these licenses and permits shall remain in effect during the operation of the <br />condominiums. <br /> <br />(k) All taxes and fees associated with the proposed project shall be paid when due. <br /> <br />3. EXPIRATION OF PERMIT: Unless extended as provided under Section <br />40-115 of the Code of the City of Portsmouth, Virginia (2006), the housing use permit <br />shall expire for any portion of the approved project for which building permits have not <br />been issued if the applicant fails to apply for all building permits for the entire project <br />within one year of the adoption of this resolution. <br /> <br />4. M. SANDLER AND SONS, INC., TO CONSTRUCT 184 TOWNHOUSE UNITS <br />ON GREENWOOD DRIVE IN CONJUNCTION WITH THE NEW PORT <br />DEVELOPMENT, PHASE 1 B. <br /> <br />WHEREAS, L. M. Sandler and Sons, Inc., pursuant to Section 40-112 of the <br />Code of the City of Portsmouth, Virginia (2006), as amended, has made application for <br />the granting of a housing use permit (HP-07 -06) to construct 184 townhouse units on <br />Greenwood Drive, Portsmouth, Virginia in conjunction with the New Port development, <br />Phase 1 B; and <br /> <br />WHEREAS, the subject property is furthermore described as: <br /> <br />HP-07-06 <br /> <br />Parcel 1 <br /> <br />BEGINNING at the intersection of the Westerly right-of-way line of Paradise Drive and <br />the Northerly right-of-way line of Greenwood Drive along a curve to the right having a <br />radius of 10.00', a delta angle of 8J0 4'43" and a length of 15.29' to a point; thence <br />along a curve to the left having a radius of 1,652.92', a delta angle of 18008' 15" and a <br />length of 523.24' to a point; thence N35055' 42"W, a distance of 76.42' to a point; thence <br />along a curve to the right having a radius of 1,729.34', a delta angle of 18043'05" and a <br />length of 564.96' to a point; thence along a curve to the left having a radius of 479.00', a <br />delta angle of 8002'32" and a length of 67.23' to the point and place of BEGINNING and <br />containing 0.961 acres. <br />
