O~:~E U.S. FISH <br />WILDLIFE SERVICE IN REGARD TO THE ROUTE OF THE CITY OF <br />~PORTS~O~TH'S WATEr,TRANSMiSSION LINE TQ BE~ST~A~LED IN <br /> SUFFOLk, VIRGINIA. ~- <br /> <br />AND <br /> <br /> WHEREAS, the City of Portsmouth has m&~etapplication to the <br />U.S. Army Corps of Engineers for a permit (Permit application <br />CENAO-CO-R 92-0004-5) to install~a~water transmission:-line in <br />Suffolk, Virginia; and <br /> <br /> WHEREAS, the~U.S. Fish and Wildlife Service has expressed <br />concerns for an endangered species known as a Dismal. Swamp <br />Southeastern Shrew (Sorex longirostris fisherii) hereinafter <br />referred to ~s "shrew"; and <br /> <br /> WHEREASi:the City of Portsmouth recognizes the concerns of <br />the U.S. Fis~ and Wildlife Service; and <br /> <br /> WHEREAS~ the final Biological Opinion will be a condition of <br />the Army Corps of Engineers Nationwide Permit 12 and failure to <br />ensure successful mitigation will violate the permit for pipeline <br />construction. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of <br />Portsmouth, 9irginia, that the City of Portsmouth will follow the <br />final guidelines set forth by the U.S. Fish and Wildlife Service <br />in their Biological Opinion by ensuring that: <br /> <br />1. A mitigRtion plan will be submitted by the City to the Fish <br /> and Wildlife Service within three (3) months of the issuance <br /> of the Corps of Engineers permit; and <br /> <br />2. No wate]~ may be transported through the transmission line <br /> until tl~e mitigation plan has been approved by the Fish and <br /> Wildlif~ Service and has been completed by the City." <br /> <br />Ayes: Clemens, Epperson, Griffin, Hawks, King, Pitts, Webb <br />Nays: None <br /> <br /> <br />
