<br />May 22, 2007 <br /> <br />2. That the Portsmouth Redevelopment and Housing Authority is hereby <br />granted a use permit pursuant to Section 40-43.1 of the Code of the City of Portsmouth, <br />Virginia (2006) for an office building at 3115 Airline Boulevard, Portsmouth, Virginia, and <br />being more particularly described as: <br /> <br />UP-07-07 <br /> <br />That parcel described as beginning at a property pin located <br />approximately 30 feet north of the centerline of the existing CSX <br />railroad rack; said pin located at the southeast corner of property <br />presently belonging to the Portsmouth Redevelopment and Housing <br />Authority. Thence, proceeding S 5J000'00"W 197.89 feet plus or <br />minus, to a point, thence N 33009'40"W 699.77 feet more or less to <br />a point, thence, proceeding N 68034'33"E 139.94E feet more or less <br />to a point thence, S16031 '46"E 170.00 feet more or less to a point, <br />thence proceeding N 68034'33"E 50.00 feet more or less to a point, <br />thence proceeding S 16031 '46"E 128.52 feet more or less to a point, <br />thence proceeding S 55053'22"W 11.14 feet more or less to a point, <br />thence proceeding S49016'48"E 390.84 feet more or less to a point <br />of beginning. The property is also known as 3115 Airline Boulevard. <br /> <br />3. That the use permit is approved subject to the following conditions which <br />shall be observed by the applicant and any successor in interest: <br /> <br />(a) A landscaping plan that is in accordance with section 40-43.5 of the City Code <br />must be submitted and approved. The plan shall include parking lot landscaping that <br />meets the criteria in City Code section 40-71.2 and at least 1 0% canopy coverage. <br />Landscaping must be located in the front 25' setback. <br /> <br />(b) The office landscaping buffer must extend the entire length of the western <br />property line from Airline Boulevard to the Seaboard Coastline Railroad tracks. <br /> <br />(c) The Best Management Practice (BMP) facility shall be located near the rear of <br />the property. <br /> <br />(d) The office building must be constructed with the submitted site plan dated <br />February 7, 2007. <br /> <br />(e) Signage shall be restricted to monument signs. A signage plan must be <br />submitted to the Zoning and Planning Departments for review and approval. <br /> <br />(f) The establishment shall be operated in compliance with all applicable codes, <br />ordinances, and regulations of federal, state, and local governments. <br /> <br />(g) The applicant shall obtain all required licenses and permits before operation and <br />these licenses and permits shall remain in effect during the operation of the <br />establ ishment <br /> <br />(h) Taxes and fees associated with the property shall be paid when due. <br /> <br />4. REVOCATION OF PERMIT: Violation of any of the above conditions may <br />serve as grounds for revocation of the use permit by the City Council." <br /> <br />07 -219 (c): <br /> <br />"RESOLUTION GRANTING A USE PERMIT TO JAMES RIZER TO OPERATE AN <br />ICE CREAM PARLOR AT 511 HIGH STREET. <br />
