(a) <br /> <br />(b) <br /> <br />(c) <br /> <br />(d) <br /> <br />(e) <br /> <br />November 10, 1997 <br /> <br />5129 <br /> <br />That the use for which~the use permit hereinafter <br />described is s0Ught:~ <br /> <br />~Will not adversely affeCt the health ~and saf. ety of <br /> persons residing or working in the neighborhood of the <br /> proposed use; <br /> <br />Will not be detrimental to the public use or injurious <br />to the property or improvements in the neighborhood; <br /> <br />Will be provided with sufficient~landscaping, to insure <br />compatibility with surrounding uses; <br /> <br />~Will be a project that will be developed according to a <br />plan for parking, driveways, and.curb cuts which will <br />provide for safe and Convenient traffid~movement; and <br /> <br />Will be in accordance with the purposes of the City of <br />Portsmouth Zoning Ordinance. <br /> <br />That Portsmouth Boat Club, Inc., is. hereby granted a <br />use permit pursuant to Section 40~43.1. of the Code of <br />the City of Portsmouth, Virginia,31988, to operate a <br />membership boat cIub at 10 Crawford Parkway, said <br />property being more particularly described as follows: <br /> <br />UP=92~18 <br /> <br /> Beginning on the north right-of-way line of <br /> Crawford Parkway a distance of 115~ more or less <br /> from the eas5 right-of-way line of Swimming Point <br /> Walk; thence running easterly along the north <br /> right-of-way of Crawford Parkway a distance of <br /> 980' more or less to a point; thence in a <br /> southeasterly direction a~distance of 254.38'; <br /> thence northeasterly 621.17' to a point in the <br /> Sou%bern Branch of the Elizabeth R'i~er; thence <br /> northerly 20' more or less to a point in said <br /> river; thence southwesterly 10' to a point; thence <br /> running northwesterly ~ distance of~ ],115~' more or <br /> less to a point in the body of wster known as <br />Crawford Bay; thence southwesterly a distance of <br />~1,210' more or les~ to~-a point; thence'sou%he~y <br />210' to the nor-th right-o.f-way line of Crawford <br /> Parkway, the point of beginning· <br /> <br /> That the use permit is approved subject to the following <br /> cond~t zons: <br /> <br />"(~a~) ~Th~. proposed club facility must be. renovated in <br /> accordance with 'the: e.le:vation shown in Exhibit A, <br /> attached hereto and made a part bere'of~ <br /> <br /> (b) The applicant must prowide a minimem of thirteen (13) <br /> parking spaces, on or off site. <br /> <br /> (c) If the club facility at anytime becomes non-taxable, <br /> th~s use permit shall expire. <br /> <br /> (d) Th~ applicant or ~any successors .in in~e~rest shall comply <br /> with all applicable codes, ordinances, and regulations <br /> of federal, state, 'and local governments a~nd shall <br /> obtain and ma. intain all necessary' licenses and permits. <br /> <br /> <br />
