(a) (b) (c) (d) (e) November 10, 1997 5129 That the use for which~the use permit hereinafter described is s0Ught:~ ~Will not adversely affeCt the health ~and saf. ety of persons residing or working in the neighborhood of the proposed use; Will not be detrimental to the public use or injurious to the property or improvements in the neighborhood; Will be provided with sufficient~landscaping, to insure compatibility with surrounding uses; ~Will be a project that will be developed according to a plan for parking, driveways, and.curb cuts which will provide for safe and Convenient traffid~movement; and Will be in accordance with the purposes of the City of Portsmouth Zoning Ordinance. That Portsmouth Boat Club, Inc., is. hereby granted a use permit pursuant to Section 40~43.1. of the Code of the City of Portsmouth, Virginia,31988, to operate a membership boat cIub at 10 Crawford Parkway, said property being more particularly described as follows: UP=92~18 Beginning on the north right-of-way line of Crawford Parkway a distance of 115~ more or less from the eas5 right-of-way line of Swimming Point Walk; thence running easterly along the north right-of-way of Crawford Parkway a distance of 980' more or less to a point; thence in a southeasterly direction a~distance of 254.38'; thence northeasterly 621.17' to a point in the Sou%bern Branch of the Elizabeth R'i~er; thence northerly 20' more or less to a point in said river; thence southwesterly 10' to a point; thence running northwesterly ~ distance of~ ],115~' more or less to a point in the body of wster known as Crawford Bay; thence southwesterly a distance of ~1,210' more or les~ to~-a point; thence'sou%he~y 210' to the nor-th right-o.f-way line of Crawford Parkway, the point of beginning· That the use permit is approved subject to the following cond~t zons: "(~a~) ~Th~. proposed club facility must be. renovated in accordance with 'the: e.le:vation shown in Exhibit A, attached hereto and made a part bere'of~ (b) The applicant must prowide a minimem of thirteen (13) parking spaces, on or off site. (c) If the club facility at anytime becomes non-taxable, th~s use permit shall expire.
