558 <br /> <br />December 8, 1992 <br /> <br /> 92-424 - Letter from the City Manager recommending that <br />the following resolutions be submitted to Portsmouth's General <br />Assembly Delegation. <br /> <br /> "I am pleased to present for your consideration the <br />recommended 1993 Legislative Proposals to the Virginia General <br />Assembly. The proposals focus on issues which are of highest <br />priority to the City, :but we will also be monitoring all <br />legislation being considered in Richmond and will be in <br />constant contract with our delegation to the General Assembly <br />to make our views' known. While we have outlined the major. <br />items in the'Legislative Proposal, other items~for - <br />consideration are included as an addendum to the legislative <br />package. _ <br /> <br /> As in recent years, the theme expressed in our proposals <br />is to give the City flexibility to respond to the demands which <br />are placed on it. The two prime ways of accomplishing this are <br />for the State to stop issuing mandates ~ithout providing the <br />funds to carry them out, and for the State to give localities <br />the means to raise the funds they need. As I staSed to you <br />last year, I consider it essential that the General Assembly <br />grant us relief, either in the form of increased revenue, or <br />through a reduction in mandated services. <br /> <br /> Further, there are proposed amendments to the City <br />Charter, some of which are necessitated by changes in State <br />law, while the others clarify certain policies and means by <br />which the Administration and the Coun-cil operate. <br /> <br /> At your work session on December 7, 1992, you will meet <br />with our legislators. A presentation will be given on changes <br />to the City Charter and the legislative proposals, and you will <br />be given and opportunity to provide input on the package. <br /> <br /> I, therefore, recommend your adoption of a resolution <br />requesting the General Assembly to amend the City Charter and a <br />resolution authorizing Portsmouth's 1993 Legislative Proposals <br />be presented to the Portsmouth Delegation and the members of <br />the Virginia General Assembly." <br /> <br /> (a) Motion of Mr.-Griffin and seconded by Mr. Clemons, to <br />adopt the resclution as presented. <br /> <br /> Substitute motion of Mr. Pitts, to defer the Charter <br />changes until January 12, 1993, to allow time to study the <br />impact of these Charter changes on the Civil Service <br />applications and promotions. The substitute motion was <br />defeated due to the lack of s second. <br /> <br /> Motion of Mr. Epperson and seccnded by Mr. Clemons, to <br />amend the resolution to substitute the words "at least five" <br />fo~ the words "the five" in Sections 11.02 (i) and 11.10 (a) <br />and was adopted by 4-1 (Pitts) vote. <br /> <br /> The following resolution as amended was adopted and by the <br />following vote: <br /> <br />"A RESOLUTION REQUESTING THE GENERAL ASSEMBLY OF VIRGINIA <br />TO AMEND THE CHAR~ER OF THE CITY OF PORTSMOUTH, VIRGINIA. <br /> <br /> WHEREAS, Section 15.1-835 of the Code~ of Virginia, 1950, <br />as amended, provides for the amendment of the City Charter upon <br />the holding of a Public Hearing and the request of the City <br />Council to the General Assembly; and <br /> <br /> <br />
