<br />February 13. 2007 <br /> <br />(g) The project complies with the standards for approval of a use permit set forth in <br />Section 40-106 of the Code of the City of Portsmouth, Virginia (2006); and <br /> <br />(h) The project provides parking, building access and pathways for persons with <br />disabilities in accordance with the requirements of the Americans with Disabilities Act. <br /> <br />2. That a group housing use permit for the construction of 13 residential <br />townhouse units at 3711 and 3715 Turnpike Road is hereby granted to the applicant <br />subject to the following terms and conditions that shall be observed by the applicant and <br />any successor in interest: <br /> <br />(a) The group housing project shall be limited to 13 townhouse units. <br /> <br />(b) The applicant shall construct the 13 units in accordance with the submitted floor <br />plans and building materials. The Directors of Planning and Zoning may approve minor <br />modifications. <br /> <br />(c) A subdivision site plan shall be submitted to the City Engineer before <br />construction begins. <br /> <br />(d) Backyard drainage shall be piped so that it does not run into a neighbor's yard. <br />No drainage shall run onto adjacent properties. <br /> <br />(e) The Homeowners' Association documents will state that the Homeowners' <br />Association is responsible for the maintenance of all landscaping and the cutting of <br />grass in the right-of-way. <br /> <br />(f) Each property will meet the City Code tree canopy coverage requirements when <br />their site plans are submitted. <br /> <br />(g) The applicant shall obtain approval from the Director of General Services of a <br />plan for the collection, storage, and disposal of solid waste and garbage prior to <br />commencement of construction. <br /> <br />(h) The cul-de-sac will be constructed at least 75 feet wide. <br /> <br />(i) The applicant shall obtain a Subdivision Permit from the City before construction <br />can begin. <br /> <br />(j) The establishment shall be operated in compliance with all applicable codes, <br />ordinances, and regulations of federal, state, and local governments. <br /> <br />(k) All required licenses and permits shall be obtained before construction and <br />remain in effect during the construction process. <br /> <br />(I) Taxes and fees associated with the property shall be paid when due. <br /> <br />3. EXPIRATION OF PERMIT: Unless extended as provided under Section <br />40-115 of the Code of the City of Portsmouth, Virginia (2006), the group housing use <br />permit shall expire for any portion of the approved project for which building permits <br />have not been issued if the applicant fails to apply for all building permits for the entire <br />project within one year of the adoption of this resolution. <br /> <br />4. REVOCATION OF PERMIT: Violation of any of the above conditions may <br />serve as grounds for revocation of the permit by the City Council." <br />
