The porti0n of the easement to be <br />vacated bisects property .now owned by the Mt. Carmel Baptist <br />Church and preclUdes the ~hUrch from having clear title 60 their <br />property. The sewer line that previously ran through this <br />property is no longer in service, has been abandoned bY the <br />Public utilities Department and has been filled With grout, <br /> I concur wlth~this raques~and aS'this is a sim~le~ <br />vacation of an easement (vs. abandonment of a right-of-way) no <br />payments to the City are involved." <br /> <br /> Motion of Mr.~ clemons and seconded by Mr. King, the <br /> following resolution was adopted, and by~ the following vote: <br /> "A RESOLUTION AUTHORIZING THE CITY MANAGER TO VACATE AND <br /> RELEASE AN EASEMENT FOR PUBLIC UTILITIES LYING ON PROPERTY OF <br /> THE MT. CARMEL BAPTIST CHURCH. <br /> <br /> WHEREAS, Mt~ Carmel Baptist Church has undertaken <br /> construction of new facilities on the hereinafter mentioned lots <br /> as laid out upon the Map of Truxtun Part 1; and <br /> WHEREAS, said facilities were constructed in such manner <br /> as to be located on a utility easement of the City of Portsmouth <br /> which lies on said hereinafter mentioned lots as shown on said <br /> map; and <br /> <br /> WHEREAS, at the time of said construction there was <br /> located within said easement a sanitary sewer line of the City <br /> of Portsmouth which served the property now or former.ly of <br /> Dorothy C. Bullock; and <br /> <br /> WHEREAS, the portion of the easement in which the sanitary <br /> sewer line was located is no longer required for public <br /> purposes; and <br /> <br /> WHEREAS, Mt. Carmel Baptist ~hurch has since provided the <br /> City of P0~tsmouth with a new sanitary sewer line to replaCe the <br /> one rendered inoperative. <br /> NOW, THEREFORE, BE IT RESOLVED by the council of the City <br /> of Portsmouth, Virginia, that the City Manager be, and he hereby <br /> is authorized to execute any and all such documents as may be <br /> necessary to release and vacate the easement for Utilities as <br /> shown on that certain plat entitled "Plat Showing Sanitary Sewer <br /> Easement To Be Vacated Adjoining Lots 31, 33, 34, and 37, Map of <br /> Truxtun Part ~i-M~.~l~Pg~6~&~3~,~ ~tsmQu~h, Virginia," dated <br /> March 8, 1993~b~ ~P~' ~'B~!~A~°ei&~es' P.C., Land <br /> Surveyors, Portsmouth, Virginia."~ <br /> Ayes: Clemons, Eppers°n, Griff~n, Hawks, King, Pitts, Webb <br /> Nays: None <br /> <br /> <br />
