March 23, 1993 WHEREAS, in order to comply with %he provisions of the Chesapeake Bay Preservation Act, the City of Portsmouth, Virginia, has been required to implement major changes in its development review ~rocedures, its ordinances, and its Comprehensive Plan; and WHEREAS, the Commonwealth of Virginia, through ~the Chesapeake Bay Local Assistance Department, has made available to localities, on a competitive basis, certain funds to help defray the Act's implementation costs; and WHEREAS, the City of Portsmouth is eligible to submit'a grant application for such funds for the 1993-94 fiscal year. NOW, THEREFORE, BE IT RESOLVED by the Council ~f the City of Portsmouth, Virginia, that the Council does hereby endorse the application for funds to offset the costs of complying with the requirements of the Chesapeake Bay Preservation Act ~during the 1993-94 fiscal year. BE IT FURTHER RESOLVED that the City Manager be, and he hereby is, authorized to submit said application for the grant, and sign all necessary documents related to the grant, certifying compliance by the City of Portsmouth with the appropriate regulations governing the administration and use of these funds." Ayes: Clemons, Epperson, Griffin, Hawks, King, Pitts, Webb Nays: none 93-118 Letter from the City Manager recommending adoption of a resolution authorizing the City Manager to submit to the Virginia Department of Transportation additions, deletions and classification changes of street mileage in order to receive quarterly maintenance payments from the State. "Each year the City of Portsmouth submits to the Virginia Department of Transportation a list of additions, deletions and changes to the streets eligible for maintenance payments.under the State Functional Classification System as set forth in Section 33.1-41.1 of the Code. These roadway sections are located primarily in new subdivisions where the streets were recently completed by the developers. The Virginia Department of Transportation requires that these lists be accompanied by a City Council Resolution. I, therefore, recommend your approval of the attached resolution to accompany our submission for highway maintenance payments." Motion of Mr. Clemons and seconded by Mr. King, the following resolution was adopted and by the following vote: "A RESOLUTION REQUESTING THE VIRGINIA DEPARTMENT OF TRANSPORTATION TO APPROVE CERTAIN ADDITIONS, DELETIONS AND CHANGES IN FUNCTIONAL CLASSIFICATION OF STREETS IN THE CITY OF PORTSMOUTH FOR THE PURPOSE OF CALCULATING MAINTENANCE PAYMENTS. WHEREAS, the regulations of the Virginia Department of Transportation adopted pursuant to Section 31.1-41.1, Code of Virginia, require that the City submit a request for changes in mileage additions, deletions and functional classification of streets which occurred during the fiscal year; and WHEREAS, the following described changes in mileage have occurred in the City of Portsmouth for the reasons specified. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia, that the Virginia Department of Transportation be requested to approve the following additions, deletions and changes in functional classification for streets in the City of Portsmouth for the purpose of calculating maintenance payments:
