March 23, 1993 <br /> <br /> WHEREAS, in order to comply with %he provisions of the <br />Chesapeake Bay Preservation Act, the City of Portsmouth, <br />Virginia, has been required to implement major changes in its <br />development review ~rocedures, its ordinances, and its <br />Comprehensive Plan; and <br /> <br /> WHEREAS, the Commonwealth of Virginia, through ~the <br />Chesapeake Bay Local Assistance Department, has made available <br />to localities, on a competitive basis, certain funds to help <br />defray the Act's implementation costs; and <br /> WHEREAS, the City of Portsmouth is eligible to submit'a <br />grant application for such funds for the 1993-94 fiscal year. <br /> NOW, THEREFORE, BE IT RESOLVED by the Council ~f the City <br /> of Portsmouth, Virginia, that the Council does hereby endorse <br /> the application for funds to offset the costs of complying with <br /> the requirements of the Chesapeake Bay Preservation Act ~during <br /> the 1993-94 fiscal year. <br /> <br /> BE IT FURTHER RESOLVED that the City Manager be, and he <br /> hereby is, authorized to submit said application for the grant, <br /> and sign all necessary documents related to the grant, <br /> certifying compliance by the City of Portsmouth with the <br /> appropriate regulations governing the administration and use of <br /> these funds." <br /> <br /> Ayes: Clemons, Epperson, Griffin, Hawks, King, Pitts, Webb <br /> Nays: none <br /> <br />93-118 Letter from the City Manager recommending adoption of a <br />resolution authorizing the City Manager to submit to the <br />Virginia Department of Transportation additions, deletions and <br />classification changes of street mileage in order to receive <br />quarterly maintenance payments from the State. <br /> "Each year the City of Portsmouth submits to the Virginia <br />Department of Transportation a list of additions, deletions and <br />changes to the streets eligible for maintenance payments.under <br />the State Functional Classification System as set forth in <br />Section 33.1-41.1 of the Code. These roadway sections are <br />located primarily in new subdivisions where the streets were <br />recently completed by the developers. <br /> <br /> The Virginia Department of Transportation requires that <br /> these lists be accompanied by a City Council Resolution. I, <br /> therefore, recommend your approval of the attached resolution to <br /> accompany our submission for highway maintenance payments." <br /> Motion of Mr. Clemons and seconded by Mr. King, the <br /> following resolution was adopted and by the following vote: <br /> "A RESOLUTION REQUESTING THE VIRGINIA DEPARTMENT OF <br /> TRANSPORTATION TO APPROVE CERTAIN ADDITIONS, DELETIONS AND <br /> CHANGES IN FUNCTIONAL CLASSIFICATION OF STREETS IN THE CITY OF <br /> PORTSMOUTH FOR THE PURPOSE OF CALCULATING MAINTENANCE PAYMENTS. <br /> WHEREAS, the regulations of the Virginia Department of <br /> Transportation adopted pursuant to Section 31.1-41.1, Code of <br /> Virginia, require that the City submit a request for changes in <br /> mileage additions, deletions and functional classification of <br /> streets which occurred during the fiscal year; and <br /> WHEREAS, the following described changes in mileage have <br /> occurred in the City of Portsmouth for the reasons specified. <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City <br /> of Portsmouth, Virginia, that the Virginia Department of <br /> Transportation be requested to approve the following additions, <br /> deletions and changes in functional classification for streets <br /> in the City of Portsmouth for the purpose of calculating <br /> maintenance payments: <br /> <br /> <br />
