That a group housing use permit for the conversion of eight <br />nonconforming apartment units into eight residential condominium units is hereby <br />granted subject to the following terms and conditions that shall be observed by the <br />applicant and any successor in interest: <br /> <br />(a) The property owner shall not, by any means, expand the nonconforming use. <br />Expansion of this nonconforming multi-family housing project shall subject the project to <br />required compliance with all conditions for approval of a group housing use permit. <br /> <br />(b) Taxes and fees associated with the property shall be paid when due. <br /> <br />3. EXPIRATION OF PERMIT: Unless extended as provided under Section <br />40-115 of the Code of the City of Portsmouth, Virginia (1988), the group housing use <br />permit shall expire for any portion of the approved project for which building permits <br />have not been issued if the applicant fails to apply for all building permits for the entire <br />project within one year of the adoption of this resolution. <br /> <br />4. REVOCATION OF PERMIT: Violation of any of the above conditions may <br />serve as grounds for revocation of the permit by the City Council." <br /> <br />06-539(d): <br /> <br />"RESOLUTION GRANTING APPROVAL OF A GROUP HOUSING USE PERMIT <br />(GHP-06-13) TO ALLEN C. TANNER, JR., TO CONVERT 78 NONCONFORMING <br />APARTMENT UNITS INTO 78 RESIDENTIAL CONDOMINIUM UNITS AT 552 <br />MADISON STREET. <br /> <br />WHEREAS, Allen C. Tanner, Jr., pursuant to Section 40-112 of the Code of the <br />City of Portsmouth, Virginia (2006), as amended, has made application for the granting <br />of a group housing use permit to convert 78 nonconforming apartment units into 78 <br />residential condominium units at 552 Madison Street, Portsmouth, Virginia; and <br /> <br />WHEREAS, the subject property is furthermore described as: <br /> <br />GHP-06-13 <br /> <br />Beginning at the northern corner of Edwards and Seventh Streets; thence, in a <br />northeasterly direction 490':t to a point; thence, in a southeasterly direction 243':t to a <br />point; thence, in a southwesterly direction 490':t to a point; thence, in a northwesterly <br />direction 243':t to a point of the beginning. <br />and <br /> <br />WHEREAS, the Planning Commission has reviewed such application and site <br />plan submitted therewith and has recommended conditional approval of said <br />application; and <br /> <br />WHEREAS, the applicant has been informed that approval of the group housing <br />project pursuant to Section 40-116 only grants an exemption from certain requirements <br />for residences as stated in said section and does not constitute a waiver of any other <br />requirement embodied in the Subdivision Ordinance, Zoning Ordinance, Code of the <br />City of Portsmouth, Virginia, or any other applicable local, state or federal law or <br />regulation; and <br /> <br />WHEREAS, the applicant is aware that building permits and any other required <br />permit will be issued only upon compliance with the ordinances, laws or regulations <br />applicable thereto. <br />
