<br />December 12. 2006 <br /> <br />2. That Synergy Flow Systems, L. L. C., is hereby granted a use permit pursuant <br />to Section 40-43.1 of the Code of the City of Portsmouth, Virginia (1988) to operate a <br />machine shop at 901 Port Centre Parkway, Portsmouth, Virginia, and being more <br />particularly described as: <br /> <br />UP-06-16 <br /> <br />Beginning at the southeast corner of Jefferson Street and Port Centre Parkway; thence, <br />in an easterly direction 356.93':t to a point; thence, in a southerly direction 242':t to a <br />point; thence, in a southwesterly direction 358.02':t to a point; thence, in a northerly <br />direction 242':t to a point of the beginning. <br /> <br />3. That the use permit is approved subject to the following conditions which shall <br />be observed by the applicant and any successor in interest: <br /> <br />(a) The site layout plan shall generally be in accordance with the site plan dated <br />September 21,2006. <br /> <br />(b) The applicant shall utilize the dumpster on site for private trash pick up in <br />accordance with the plan of trash storage, handling, and disposal approved by <br />General Services. <br /> <br />(c) The applicant's machine shop shall not generate sound or vibrations that can be <br />heard or felt by adjacent businesses. <br /> <br />(d) Upon approval, uses allowed under this use permit shall be limited to the <br />fabrication of small pipe fittings and flanges as described in the application submitted on <br />September 21,2006. <br /> <br />(e) The establishment shall be operated in compliance with all applicable codes, <br />ordinances, and regulations of federal, state, and local governments. <br /> <br />(f) The applicant shall obtain all required licenses and permits before operation and <br />these licenses and permits shall remain in effect during the operation of the <br />establ ishment. <br /> <br />(g) Taxes and fees associated with the property shall be paid when due. <br /> <br />(h) This use permit shall be for the entire parcel to allow the applicant the ability to <br />expand in the future. <br /> <br />4. REVOCATION OF PERMIT: Violation of any of the above conditions may <br />serve as grounds for revocation of the use permit by the City Council." <br /> <br />06-539(c): <br /> <br />"RESOLUTION GRANTING APPROVAL OF A GROUP HOUSING USE PERMIT <br />(GHP-06-12) TO NORTH STREET PROPERTIES, L.L.C., TO CONVERT EIGHT <br />NONCONFORMING APARTMENT UNITS INTO EIGHT RESIDENTIAL <br />CONDOMINIUM UNITS AT 525 NORTH STREET. <br /> <br />WHEREAS, Michael R. Bailey, Managing Member of North Street Properties, <br />L. L. C., pursuant to Section 40-112 of the Code of the City of Portsmouth, Virginia <br />(2006), as amended, has made application for the granting of a group housing use <br />permit to convert eight nonconforming apartment units into eight residential <br />condominium units at 525 North Street, Portsmouth, Virginia; and <br /> <br />WHEREAS, the subject property is furthermore described as: <br />
