December 12. 2006 At a Called Meeting of the City Council on Tuesday, December 12, 2006, there were present: Mayor James W. Holley, III, Vice Mayor Marlene W. Randall, William E. Moody, Jr., Stephen E. Heretick, Elizabeth M. Psi mas, Ray A. Smith, Sr., Douglas L. Smith, City Manager James B. Oliver, Jr., Senior Deputy City Attorney George M. Willson. 06 - 562 - The following call for the meeting was read: "Please attend a Called Meeting of the City Council to be held in the City Council Chamber, 801 Crawford Street, 5:00 p.m., Tuesday, December 12, 2006 for the purpose of a Public Work Session. In addition, you may consider a motion to go into a Closed Meeting. By order of the Mayor." 06 - 563 - The following items were discussed in Public Work Session: 1. Public Safety Briefing 2. FY 2007-2008 Budget Presentation Boat Tax Briefing 06 - 564 - Motion by Mr. Moody, and seconded by Ms. Randall, to go into Closed Meeting pursuant to provisions of Section 2.2-3711 (A) of the Code of Virginia, to consult: - with legal counsel and staff members pertaining to pending or threatened litigation and specific legal matters, as per subsection 7. The subject matter of the meeting will be several pending EEOC discrimination claims. The purpose of the meeting IS to permit confidential discussion of legal strategy. The motion was adopted by the following vote: Ayes: Heretick, Moody, Psi mas, Randall, D. Smith, R. Smith, Holley Nays: None Motion by Mr. D. Smith, and seconded by Ms. Psimas, pursuant to Section 2.2- 3712(D) of the Code of Virginia, certifying that to the best of the Council Members' knowledge during the immediately preceding Closed Meeting of the City Council: 1. Only public business matters lawfully exempted from open meeting requirements by the Virginia Freedom of Information Act, and 2. Only such public business matters as were identified in the motion, by which the Closed Meeting was convened, were heard, discussed or considered in the meeting by the City Council. The motion was adopted by unanimous vote.
