November 14. 2006 Motion by Mr. Moody and seconded by Mr. R. Smith, to adopt the following ordinance, and was adopted by the following vote: "ORDINANCE ACCEPTING $229,559 IN ADDITIONAL TEMPORARY ASSISTANCE FOR NEEDY FAMILIES (TANF) PROGRAM FUNDS AND APPROPRIATING THE SAME AMOUNT IN THE FY 2006-2007 SOCIAL SERVICES FUND OPERATING BUDGET FOR THE VIRGINIA INITIATIVE FOR EMPLOYMENT NOT WELFARE (VIEW) PROGRAM." Ayes: Heretick, Moody, Psi mas, Randall, D. Smith, R. Smith, Holley Nays: None 06 - 514 - Adoption of a resolution authorizing the City Manager to execute a deed of release for a sewer easement over, under and across Lot 2, Block H, on the map of Truxton, Part 2. Vision Principle: Neighborhood and Community Transformation. Background: . Ms. Cynthia L. Lowe, the owner of this property, desires to construct a new outbuilding behind her home on this parcel. . The City has an eight-foot wide utility easement on this property that is in conflict with the proposed use. Discussion: . At the request of Ms. Lowe, Public Utilities investigated the area within the easement to determine the existence and location of utilities. . It has been determined that no utilities exist within this portion of easement area and there are no proposed plans to install utilities within this easement. There is no further need for this easement. Financial Impact: . The release of this easement will allow the current resident to construct an outbuilding on this parcel. There is no financial impact on the City. Staff Recommends: Adoption of a proposed resolution. Vision Principle: Neighborhood and Community Transformation. Next Steps following City Council Action: . The City Manager will execute the Deed of Release and any other required documents on behalf of the City to complete the release of this portion of the easement. . The office of the City Attorney will see to the preparation of appropriate documents to be presented to the City Manager for his execution releasing this easement. Motion by Ms. Psi mas, and seconded by Ms. Randall, to adopt the following resolution, and was adopted by the following vote: "RESOLUTION AUTHORIZING THE CITY MANAGER TO EXECUTE A DEED OF RELEASE FOR A SEWER EASEMENT OVER, UNDER AND ACROSS LOT 2, BLOCK H, ON THE MAP OF TRUXTON, PART 2. BE IT RESOLVED, by the Council of the City of Portsmouth that the City Manager be, and he hereby is, authorized to execute a Deed of Release and any other documents as may be required to the owner(s) of Lot 2, Block H, as shown on the Map of Truxton, Part 2, duly recorded in the Clerk's Office of the Circuit Court of the City of Portsmouth in Map Book 1, at page 37, releasing to such owner(s) all right, title and interest, if any, which the City of Portsmouth has, or may have, in and to an easement for a sewer line as shown on the aforementioned plat."
