<br />At a Regular Meeting of the City Council on Tuesday, October 24, 2006 there
<br />were present:
<br />
<br />Vice Mayor Marlene W. Randall, *William E. Moody, Jr., Stephen E. Heretick, Elizabeth
<br />M. Psimas, Ray A. Smith, Sr., Douglas L. Smith, City Manager James B. Oliver, Jr., City
<br />Attorney G. Timothy Oksman.
<br />
<br />Councilman Douglas L. Smith opened the meeting with prayer, which was
<br />followed by the Pledge of Allegiance to the Flag.
<br />
<br />Vice Mayor Randall called the meeting to order and welcomed all In
<br />attendance.
<br />
<br />Motion by Ms. Psi mas, and seconded by Mr. Moody, to approve the minutes of a
<br />Called Meeting on October 5, 2006, of a Called Meeting on October 9, 2006, of a Called
<br />Meeting on October 10, 2006, and of a Regular Meeting on October 10, 2006, and were
<br />adopted by the following vote:
<br />
<br />Ayes: Heretick, Moody, Psi mas, D. Smith, R. Smith, Randall
<br />Nays: None
<br />
<br />Motion by Ms. Psi mas, and seconded by Mr. Heretick, to change the order of
<br />business to permit consideration of Agenda Items 06-492 and 06-493 simultaneously
<br />with the public hearing on the proposed Covanta project, and was adopted by the
<br />following vote:
<br />
<br />Ayes: Heretick, Moody, Psi mas, D. Smith, R. Smith, Randall
<br />Nays: None
<br />
<br />Motion by Mr. R. Smith, and seconded by Mr. Moody, that Agenda Items 06-492
<br />and 06-493 be denied and that the public hearing be withdrawn, by the following vote:

<br />Councilman Moody, on behalf of Mayor Holley, read the following statement:
<br />
<br />My fellow City Council members and citizens, unfortunately, previously scheduled plans
<br />have taken me away from the City of Portsmouth at a critical time where a vote of the
<br />Term Sheet for the Covants/SPSA proposal is before us.
<br />
<br />As your Mayor, I am opposed to the proposed Term Sheet and proposal that have been
<br />given to us. While I understand we do not have an absentee vote on this issue, it was
<br />important to me that our citizens know where I stand on this issue.

<br />Public hearing on a proposed Term Sheet leading to a contract between
<br />the City of Portsmouth, the Portsmouth Port and Industrial Commission,
<br />and the Transriver Portsmouth LLC, a subsidiary of Covanta Energy
<br />Corporation, concerning the lease of certain property to serve as a
<br />Transfer Station of municipal solid waste.
<br />
<br />06 - 492 - Adoption of a resolution authorizing a Memorandum of Intent with the
<br />Southeastern Public Service Authority ("SPSA") concerning improvement of the SPSA
<br />waste-to-energy facilities on Elm Avenue.
<br />
<br />06 - 493 - Adoption of a resolution concerning a Term Sheet and a Lease with
<br />Transriver Portsmouth, LLC, a subsidiary of Covanta Energy Corporation, concerning
<br />the use of certain property as a transfer station for municipal solid waste.
<br />
<br />Ayes: Heretick, Moody, Psi mas, D. Smith, R. Smith, Randall
