October 24. 2006 At a Called Meeting of the City Council on Tuesday, October 24, 2006, there were present: Vice Mayor Marlene W. Randall, Stephen E. Heretick, Elizabeth M. Psi mas, Ray A. Smith, Sr., Douglas L. Smith, City Manager James B. Oliver, Jr., City Attorney G. Timothy Oksman. 06 - 483 - The following call for the meeting was read: "Please attend a Called Meeting of the City Council to be held in the City Council Chamber, 801 Crawford Street, 5:00 p.m., Tuesday, October 24, 2006 for the purpose of a Public Work Session. In addition, you may consider a motion to go into a Closed Meeting. By order of the Mayor." 06 - 484 - Motion by Mr. R. Smith, and seconded by Ms. Psimas, to go into Closed Meeting pursuant to provisions of Section 2.2-3711 (A) of the Code of Virginia, to discuss: personnel matters, as per subsection 1; and legal matters requiring the advice of legal counsel, as per subsection 7. The subject matter of the meeting includes the performance of appointees to boards and commissions and also legal matter related to possible contracts with Covanta and the Southeastern Public Service Authority of Virginia. The purpose of the meeting is to permit confidential discussion of personnel matters and possible contract negotiations. The motion was adopted by unanimous vote. Motion by Mr. R. Smith, and seconded by Mr. D. Smith, pursuant to Section 2.2-3712(D) of the Code of Virginia, certifying that to the best of the Council Members' knowledge during the immediately preceding Closed Meeting of the City Council: 1. Only public business matters lawfully exempted from open meeting requirements by the Virginia Freedom of Information Act, and 2. Only such public business matters as were identified in the motion, by which the Closed Meeting was convened, were heard, discussed or considered in the meeting by the City Council. The motion was adopted by unanimous vote. 06 - 485 - The following items were discussed in Public Work Session: 1. Proposed 2007 Legislative Package - Sherri Neil 2. CAR Appeal Discussion Motion by Mr. D. Smith, and seconded by Mr. R. Smith, to postpone consideration of the Commission of Architectural Review (Port Norfolk/Park View and Olde Towne, Cradock, and Truxton) denial to retain replacement windows, at 257-259 Mt. Vernon Avenue and 7 Dahlgren Avenue, indefinitely, and was adopted by the following vote:
