<br />September 26, 2006 <br /> <br />(c) The center shall comply with the submitted site plan and floor plan. <br /> <br />(d) The days and hours of operation shall be Monday through Friday, 6:30 a.m. to <br />6:00 p.m. <br /> <br />(e) The 2,116 square foot outdoor play area shall be enclosed with at least 4-foot <br />high fencing. <br /> <br />(f) The Downtown Design Committee shall approve the style of the outdoor play <br />area fencing. <br /> <br />(g) No more than 21 children may occupy the play area at anyone time. <br /> <br />(h) Outdoor play hours shall be between 8:00 a.m. and 6:00 p.m. <br /> <br />(i) Parking for instructors and the drop-off and pick-up of children shall take place <br />within the church parking lot. <br /> <br />(j) The applicant shall adhere to the Downtown 0-2, 10% tree canopy requirement. <br />All planting of trees shall be completed prior to beginning the operation of the day care <br />center. <br /> <br />(k) The applicant shall provide a RPZ backflow preventer installed downstream of <br />the water meter as required by Public Utilities. <br /> <br />(I) The center shall submit to all required inspections and approvals obtained by the <br />City's Fire Department Bureau, Public Health Department and Building Official. This <br />shall include an initial inspection prior to the opening of the center and annual <br />inspections thereafter. <br /> <br />(m) The applicant shall comply with the Statewide Building Code. <br /> <br />(n) The applicant shall comply with all applicable codes, ordinances and regulations <br />of federal, state and local governments and shall obtain and maintain all necessary <br />licenses and permits. <br /> <br />(0) All fees in connection with the proposed use shall be paid when due. <br /> <br />4. REVOCATION OF PERMIT: Violation of any of the above conditions may <br />serve as grounds for revocation of the use permit by the City Council." <br /> <br />Ayes: Heretick, Psi mas, Randall, D. Smith, R. Smith, Holley <br />Nays: None <br /> <br />Motion by Ms. Psi mas, and seconded by Mr. Heretick, to adopt the following <br />resolution approved on first reading at the September 12, 2006 meeting, and was <br />adopted by the following vote: <br /> <br />06 - 414(c): <br /> <br />"RESOLUTION GRANTING A USE PERMIT TO MYRA DUNN TO OPERATE AN <br />ENTERTAINMENT ESTABLISHMENT AT 107 CHOWAN DRIVE. <br /> <br />WHEREAS, Myra Dunn has made application, pursuant to Section 40-43.1 of <br />the Code of the City of Portsmouth, Virginia (1988) for the granting of a use permit for <br />an entertainment establishment at 107 Chowan Drive, Portsmouth, Virginia; and <br /> <br />WHEREAS, the applicant and the Planning Director have done all things <br />required to be done in connection with said application; and <br />
