September 26, 2006 At a Regular Meeting of the City Council on Tuesday, September 26, 2006, there were present: Mayor James W. Holley III, Vice Mayor Marlene W. Randall, *William E. Moody, Jr., Stephen E. Heretick, Elizabeth M. Psi mas, Ray A. Smith, Sr., Douglas L. Smith, City Manager James B. Oliver, Jr., City Attorney G. Timothy Oksman. Vice Mayor Marlene W. Randall, opened the meeting with prayer, which was followed by the Pledge of Allegiance to the Flag. Mayor Holley called the meeting to order and welcomed all in attendance. Motion by Mr. Heretick, and seconded by Mr. D. Smith, to approve the minutes of a Called Meeting on September 12, 2006, and of a Regular Meeting on September 12, 2006, and was adopted by the following vote: Ayes: Heretick, Psi mas, Randall, D. Smith, R. Smith, Holley Nays: None 06 - 432 - Presentation: . Presentation of a plaque by Mr. Tom Swanston, on behalf of Chesapeake Service Systems, to the City of Portsmouth. - Public Hearing - 06 - 433 Public hearing on three proposed ordinances to amend and increase the FY 2006-2007 Operating Budget through supplemental appropriation: (1) An ordinance appropriating $734,829 in the FY 2006-2007 General Fund Operating Budget for an additional CIP transfer of $74,829 with funding to be provided by an operating transfer received from the Portsmouth Public Schools and an additional risk management charge of $660,000 with funding to be provided from the fund balance designation for subsequent year expenditures as of June 30, 2006, (2) An ordinance appropriating $74,829 in the FY 2006-2007 Capital Projects Fund capital budget within the Capital Improvement Program (CIP) for an additional First College educational capital project expenditure with funding to be provided by a CIP transfer from the General Fund, and (3) An ordinance appropriating $660,000 in the FY 2006-2007 Risk Management Fund Operating Budget for an additional general liability claims expenditure resulting from a legal settlement, with Harbor Center Joint Venture, with funding to be provided by internal service charge-out revenue from the General Fund. There were no speakers. - Unfinished Business - 06 - 414 - Use permits: Motion by Mr. Heretick, and seconded by Ms. Psimas, to adopt the following resolution approved on first reading at the September 12, 2006 meeting, and was adopted by the following vote:
