<br />September 26, 2006 <br /> <br />Next Steps Following Council Action: <br />. By September 18, 2006, the Elizabeth River Project Board will authorize <br />proceeding with purchase of Phase I of property, 16.5 acres, by October 10, 2006 <br />closing date in purchase agreement. Second phase of purchase by September 2007. <br />. City of Portsmouth to work with Elizabeth River Project to refine all operational <br />and maintenance elements of the project so as to result in a smooth transfer and City <br />ownership in 2009/2010. <br /> <br />Motion by Mr. Moody, and seconded by Mr. D. Smith, to adopt the following <br />resolution, and was adopted by the following vote: <br /> <br />"RESOLUTION AUTHORIZING A WRITTEN AGREEMENT CONCERNING <br />PARADISE CREEK NATURE PARK. <br /> <br />BE IT RESOLVED by the Council of the City of Portsmouth, Virginia, that the <br />City Manager, acting for and on behalf of the city, is hereby authorized and directed to <br />execute, deliver, and implement a "Written Agreement Concerning Paradise Creek <br />Nature Park" substantially the same as Exhibit A which is attached hereto. <br /> <br />This resolution shall be effective immediately upon its adoption." <br /> <br />Ayes: Heretick, Moody, Psi mas, Randall, D. Smith, Holley <br />Nays: None <br /> <br />06 - 438 - Adoption of an ordinance to amend Chapter 16 of the Code of the City of <br />Portsmouth, Virginia (1988) by amending Sections 16-1, 16-2, 16-5(a), 16-6, 16-7(a) <br />and (b)(1), 16-31, 16-32, 16-34 through 16-37, 16-39, 16-62(c), 16-64, 16-66, 16-69, <br />and 16-70 thereof, by adopti ng new Sections 16-1 0 and 16-60, and by repeal i ng <br />Sections 16-63 and 16-65 pertaining to the collection of garbage and refuse. Vision <br />Principle: Neighborhood and Community Transformation. <br /> <br />1. Mark Geduldig-Yatrofsky, 363 Middle Street, spoke in support of this item. <br /> <br />Background: <br />. A Debris Task Force made up of citizens, city council members and city staff has <br />reviewed Chapter 16 of the City Code (Garbage and Refuse). <br />. Civic leader and civic group engagement since May 2006. <br />. The purpose of the Task Force was to enhance neighborhood quality and insure <br />compliance of the city code relative to waste disposal and collection issues. <br /> <br />Discussion: <br />. Waste collection is an important component of neighborhood quality. <br />. The city proposes to amend Chapter 16 of the city code to define the size of bulk <br />refuse piles and limit the amount of time those piles can be on the street waiting for <br />collection. <br />. A section has been added to Chapter 16, which will allow the city to regulate <br />commercial dumpsters. <br />. Fines, fees, and other charges have been added for violations. <br />. It is recommended that exemptions from the monthly $22 refuse fee be <br />eliminated. Exemptions currently cost the city approximately $82,000 per year in fees, <br />refunds and administrative costs. <br />. Financial Impact: Eliminating exemptions will save the city $57,000 per year in <br />direct revenue. Penalties and fines will be returned to the Waste Management Division. <br /> <br />Staff Recommends: <br />Adoption of proposed ordinance.
