AUC~Ast 24, 1993 <br /> <br />(g) The project complies with the standards for approval of a <br />use permit set forth in Section 40-106 of the Code of the City <br />of Portsmouth, Virginia~ and <br /> <br />(h) The project provides parking, building access and pathways <br />for persons with disabilities in accordance with the <br />requirements of the Americans with Disabilities Act. <br /> <br /> 2. That a group housing use permit for the construction <br />of 160 condominium units on River Pointe Parkway on a portion <br />of Tax Map 709, Parcel 1.2 is hereby granted subject to the <br />following terms and conditions: <br /> <br /> (a) The groUP housing project shall be limited to' 160 <br />condominium units (sixteen buildings). <br /> <br /> (b) The exterior of the condominium units shall be <br />constructed of the same materials and architectural designs and <br />details used in the "Wimbledon Chase" development in <br />Chesapeake, Virginia. Architectural changes may be approved by <br />the Planning Commission prior to the issuance of a building <br />permit. <br /> <br /> (c) Site layout and landscaping shall be in accordance <br />with Exhibits A and B, attached hereto and made a part hereof. <br />Minor modifications may be made by the Planning Director prior <br />to issuance of building permits. <br /> <br /> (d} A Landscaping Group 2 buffer shall be planted along <br />River Pointe Parkway and River Pointe Drive prior to completion <br />of 25% of construction. <br /> <br /> (e) The site plan must conform to all requirements of the <br />Chesapeake Bay Preservation Area Overlay Ordinance and the Tree <br />Planting and Replacement Ordinance, contained in the Code of <br />the City of Portsmouth. <br /> <br /> (f) The applicant shall preserve and protect existing <br />trees in the Resource Protection Area of the Chesapeake Bay <br />Preservation Area. <br /> <br /> (g) Street lighting with high pressure sodium fixtures <br />shall be provided along all private streets in accordance with <br />recommended Illumination Engineering Standards (I.E.S.) as <br />contained in Ameri~ National Standard Practice for Roadway <br />Liqhtinq. A lighting plan for the development must be approved <br />by the Department of Traffic Engineering prior to issuance of <br />building permits. <br /> <br /> (h) A condominium owners association shall be created and <br />shall be responsible for maintaining the retention lake, <br />private roadways and recreation area. The association may <br />annually collect and place in reserve sufficient funds for such <br />maintenance~ The association may regulate off-street parking <br />and prohibit on-street parking on the private street. <br /> <br /> (i) The community swimming pool and club house shall be <br />constructed and in use by the time 50% of the units are <br />completed. The developer shall expand to five (5) acres the <br />area designated as "recreational site" on Exhibit C, attached <br />hereto and made a part hereof. The swimming pool and club <br />house may be located in this area. The applicant shall seek to <br />have rezoned or agree to allow the City of Portsmouth to rezone <br />the designated recreational site as Preservation (P-l). The <br />rezoning shall be complete prior to issuance of more than 50% <br />of the certificates of occupancy. <br /> <br /> <br />
