AUQust 28. 2006 At a Special Called Meeting of the City Council on Monday, August 28, 2006, there were present: Mayor James W. Holley III, Vice Mayor Marlene W. Randall, *William E. Moody, Jr., *Stephen E. Heretick, Elizabeth M. Psimas, Douglas L. Smith, Ray A. Smith, Sr., City Manager James B. Oliver, Jr., City Attorney G. Timothy Oksman. 06 - 395 - The following call for the meeting was read: "Please attend a Special Called Meeting of the City Council to be held in the City Council Chamber, 801 Crawford Street, 4:00 p.m., Monday, August 28, 2006 for the purpose of a Public Work Session. In addition, you may consider a motion to go into a Closed Meeting. By order of the Mayor." 06 - 396 - The following items were discussed in Public Work Session: 1. Southeastern Public Service Authority (SPSA) - (Phone Conference with Bill Zieburtz) 06 - 397 - Motion by Mr. Moody, and seconded by Ms. Randall, to go into Closed Meeting pursuant to provisions of Section 2.2-3711 (A) of the Code of Virginia, to discuss or consider the following subjects: briefing by legal counsel and staff on legal matters, including threatened and actual litigation, as per subsection 7. the acquisition of real property for a public purpose, or the disposition of publicly held property, where competition or bargaining is involved, as per subsection 3; and a new business or prospective business expansion which has not been previously announced, as per subsection 5. The subject matter of the meeting entails litigation related to SPSA, and also economic development projects. The purpose of the meeting is to permit confidential discussion of strategy. The motion was adopted by unanimous vote. Motion by Mr. Moody, and seconded by Ms. Psimas, pursuant to Section 2.2-3712(0) of the Code of Virginia, certifying that to the best of the Council Members' knowledge during the immediately preceding Closed Meeting of the City Council: 1. Only public business matters lawfully exempted from open meeting requirements by the Virginia Freedom of Information Act, and 2. Only such public business matters as were identified in the motion, by which the Closed Meeting was convened, were heard, discussed or considered in the meeting by the City Council. The motion was adopted by unanimous vote.
