<br />AUQust 8. 2006 <br /> <br />Background: <br />. This 3.16 parcel of land is the former Manufactured Gas Plant site. This former <br />use has left certain environmental contaminants in the soil, and Columbia Gas has <br />undertaken a remediation of this site in compliance with all applicable state and federal <br />environmental requirements. <br />. Columbia Gas desires to dedicate this property for use as a public park, and it is <br />performing the design and construction of the same. <br />. Once Columbia Gas completes the park, it desires to lease the park to the City <br />for 99 years. <br /> <br />Discussion: <br />. The City has worked with NiSource (Columbia Gas) to facilitate the design and <br />construction of the "Fort Nelson Park." NiScource obtained this site after its merger with <br />Columbia Gas of Virginia, Inc. in November 2000. The gas company began its <br />remediation of the property in 1990, and it completed the same in 2005. <br />. The park is the northern terminus the Path of History, and we intend to dedicate <br />and open the park in September 2006. <br /> <br />Financial Impact: The rental payment for the entire 99 year term is $100 and due <br />upon commencement of the lease. <br /> <br />Staff Recommends: <br />Adoption of proposed resolution. Smith, and seconded by Ms. Psi mas, to adopt the following <br />resolution, and was adopted by the following vote: <br /> <br />"RESOLUTION AUTHORIZING THE EXECUTION OF THE 99 YEAR GROUND <br />LEASE AND PARK DEVELOPMENT AGREEMENT WITH COLUMBIA GAS OF <br />VIRGINIA FOR THE FORMER MANUFACTURED GAS PLANT SITE, LOCATED <br />GENERALLY AT THE NORTHEAST CORNER OF THE INTERSECTION OF <br />EFFINGHAM STREET AND CRAWFORD PARKWAY TO BE DESIGNATED AS <br />"FORT NELSON PARK". <br /> <br />WHEREAS, there is a parcel of land containing approximately 3.16 acres, more <br />or less, located generally at the northeast corner of the intersection of Effingham Street <br />and Crawford Parkway, known generally as the former Manufactured Gas Plant site (the <br />"Property"); and <br /> <br />WHEREAS, the Property was in past years used for certain manufacturing <br />purposes, and such use has left certain environmental contaminants in the soil; and <br />Columbia has for some time been involved in remediation of this site, in compliance <br />with applicable state and federal environmental requirements; and <br /> <br />WHEREAS, the Property is now owned by Columbia Gas of Virginia <br />("Columbia"); and <br /> <br />WHEREAS, Columbia desires to dedicate the Property to be used as a public <br />park, and is performing such design and construction work for said use, up to a mutually <br />agreed financial cap, and with the Property thereafter to be leased long-term to the City <br />for nominal rent; and <br /> <br />WHEREAS, the City agrees that use as a public park IS desirable for the <br />Property; and that it shall be designated as "Fort Nelson Park". <br />
