Julv 10. 2006 At a Called Meeting of the City Council on Monday, July 10, 2006, there were present: Mayor James W. Holley III, Vice Mayor Marlene W. Randall, *William E. Moody, Jr., *Stephen E. Heretick, Elizabeth M. Psi mas, Ray A. Smith, Sr., Douglas L. Smith, City Manager James B. Oliver, Jr., City Attorney G. Timothy Oksman. 06 - 305 - The following call for the meeting was read: "Please attend a Called Meeting of the City Council to be held in the 6th Floor Conference Room, 801 Crawford Street, 5:00 p.m., Monday, July 10, 2006 for the purpose of a Public Work Session. In addition, you may consider a motion to go into a Closed Meeting. By order of the Mayor." 06 - 306 - The following items were discussed in Public Work Session: 1. World Class Maritime Center Vision Principle Special Work Session 2. Court Complex 06 - 307 - Motion by Mr. Moody, and seconded by Ms. Psi mas, to go into Closed Meeting pursuant to provisions of Section 2.2-3711 (A) of the Code of Virginia, to discuss or consider legal matter including threatened litigation, and also unannounced economic development matters. This motion is made pursuant to the following subsections of said statute: subsection 7, specific litigation matters requiring the advice of legal counsel and briefings by staff; subsection 3, the possible disposition of publicly held real estate; and subsection 5, prospective business which has not been previously announced. The subject matter of the meeting consists of threatened litigation and a potential economic development project. The purpose of the meeting is to permit confidential discussion of negotiating strategy for these matters. The motion was adopted by unanimous vote. Motion by Mr. Moody, and seconded by Ms. Psi mas, pursuant to Section 2.2- 3712(0) of the Code of Virginia, certifying that to the best of the Council Members' knowledge during the immediately preceding Closed Meeting of the City Council: 1. Only public business matters lawfully exempted from open meeting requirements by the Virginia Freedom of Information Act, and 2. Only such public business matters as were identified in the motion by which the Closed Meeting was convened, were heard, discussed or considered in the meeting by the City Council. The motion was adopted by unanimous vote.
