<br />June 27.2006 <br /> <br />Next Steps following City Council Action: <br />. The City Manager will execute the Deed of Release and any other required <br />documents on behalf of the City to complete the release of this portion of the easement. <br />. The office of the City Attorney will see to the preparation of appropriate <br />documents to be presented to the City Manager for his execution releasing this <br />easement. <br /> <br />Motion by Ms. Randall, and seconded by Mr. Whitehurst, to adopt the following <br />resolution, and was adopted by the following vote: <br /> <br />"RESOLUTION AUTHORIZING THE CITY MANAGER TO EXECUTE A DEED OF <br />RELEASE FOR AN EIGHT-FOOT WATER LINE EASEMENT OVER, UNDER AND <br />ACROSS LOT 181N BLOCK 0 ON THE MAP OF TRUXTUN. <br /> <br />BE IT RESOLVED by the Council of the City of Portsmouth that the City <br />Manager be, and he hereby is, authorized to execute a Deed of Release and any other <br />documents as may be required to the owner(s) of Lot 18 in Block 0 as shown on the <br />Map of Truxtun, duly recorded in the Clerk's Office of the Circuit of the City of <br />Portsmouth in Map 1, at pages36 and 37, releasing to such owner(s) all right, title and <br />interest, if any, which the City of Portsmouth has, or may have, in and to an easement <br />for water mains of eight feet in width as shown on the aforementioned plat." <br /> <br />Ayes: Moody, Psimas, Randall, Smith, Whitehurst, Holley <br />Nays: None <br /> <br />- New Business - <br /> <br />06 - 293 - Boards and Commissions <br /> <br />There were no appointments. <br /> <br />06 - 294 - Items Submitted by Council Members <br /> <br />'" Councilwoman Psi mas, on behalf of Councilman Heretick, read a statement of <br />support of the final resolution of the Friendship Temple Revised Settlement <br />Agreement. <br /> <br />Motion by Mr. Smith, and seconded by Mr. Whitehurst, to amend the agenda by <br />adding a resolution approving a Revised Settlement Agreement in the Friendship <br />Temple lawsuit, and was adopted by the following vote: <br /> <br />Ayes: Moody, Psimas, Randall, Smith, Whitehurst, Holley <br />Nays: None <br /> <br />Motion by Ms. Psi mas, and seconded by Mr. Moody, to adopt the following <br />resolution, and was adopted by the following vote: <br /> <br />"RESOLUTION APPROVING A REVISED SETTLEMENT AGREEMENT WITH DR. <br />JOSEPH A. CHASE, JR. AND KATRINA CHASE, CONCERNING FRIENDSHIP <br />TEMPLE. <br /> <br />BE IT RESOLVED by the Council of the City of Portsmouth, Virginia, that the <br />attached settlement agreement between the City of Portsmouth, Virginia and Dr. Joseph <br />A. Chase, Jr. and Katrina Chase, concerning Friendship Temple, is hereby authorized <br />and approved. <br />
