<br /> <br />121 <br /> <br />June 26. 2006 <br /> <br />At a Called Meeting of the City Council on Monday, June 26, 2006, there were <br />present: <br /> <br />*Mayor James W. Holley III, Vice Mayor William E. Moody, Jr., Charles B. Whitehurst, <br />Sr., Marlene W. Randall, Stephen E. Heretick, Elizabeth M. Psimas, *Ray A. Smith, <br />Sr., City Manager James B. Oliver, Jr., City Attorney G. Timothy Oksman. <br /> <br />06 - 271 - The following call for the meeting was read: <br /> <br />"Please attend a Called Meeting of the City Council to be held in the 6th Floor <br />Conference Room, 801 Crawford Street, 4:30 p.m., Monday, June 26, 2006 for the <br />purpose of a Closed Meeting. <br /> <br />By order of the Mayor." <br /> <br />06 - 272 - Motion by Ms. Psimas, and seconded by Mr. Whitehurst, to go into Closed <br />Meeting pursuant to provisions of Section 2.2-3711 (A) of the Code of Virginia: <br /> <br />to consult with legal counsel and staff members pertaining to pending or <br />threatened litigation and specific legal matters, as per subsection 7. <br /> <br />The subject matter of the meeting will be the "Friendship Temple" or "Garden or <br />Prayer" Church. <br /> <br />The purpose of the meeting is to permit confidential discussion of legal <br />strategy. <br /> <br />The motion was adopted by unanimous vote. <br /> <br />Motion by Mr. Moody, and seconded by Mr. Whitehurst, pursuant to Section <br />2.2-3712(0) of the Code of Virginia, certifying that to the best of the Council Members' <br />knowledge during the immediately preceding Closed Meeting of the City Council: <br /> <br />1. Only public business matters lawfully exempted from open meeting <br />requirements by the Virginia Freedom of Information Act, and <br /> <br />2. Only such public business matters as were identified in the motion, by which <br />the Closed Meeting was convened, were heard, discussed or considered in <br />the meeting by the City Council. <br /> <br />The motion was adopted by unanimous vote. <br /> <br />~ Mayor Holley read a statement. <br /> <br />~ Councilman Smith outlined the terms of the settlement. <br /> <br />On motion, meeting adjourned at 7:05 p.m. <br /> <br /> <br />Ita'Y.
