<br />April 25. 2006 <br /> <br />(d) Will be a project that will be developed according to a plan for parking, <br />driveways, and curb cuts which will provide for safe and convenient traffic movement; <br />and <br /> <br />(e) Will be in accordance with the purposes of the City of Portsmouth Zoning <br />Ordinance. <br /> <br />2. That AI Pratz Brewing Company, L. L. C., is hereby granted a use permit <br />pursuant to Section 40-43.1 of the Code of the City of Portsmouth, Virginia (1988) to <br />operate a brew pub and restaurant at 615 High Street, and being more particularly <br />described as: <br /> <br />UP-06-05 <br />Parcel 1 <br /> <br />Beginning at a point on the South side of High Street which said point is a distant 90 <br />feet due West from the intersection of the South side of High Street with the Western <br />line of Washington Street and from said point of beginning South 00 18" 51" West a <br />distance of 59.83 feet to a point; thence South 00 12' 56" East a distance of 53.20 feet <br />to a point; thence North 890 56" 19" West a distance of 59.69 feet to a point in the <br />dividing line of the property herein conveyed and property now or formerly Dyson; <br />thence along said dividing line North 00 25' 30" West a distance of 113.14 feet (113 feet <br />by deed description) to a point in the Southern side of High Street; thence due East <br />along the Southern side of High Street a distance of 60 feet to the point of beginning. <br /> <br />Parcel 2 <br /> <br />Beginning at a point in the North side of King Street which said plat is North 890 52' 37" <br />West a distance of 105 feet from the intersection of North side of King Street with the <br />Western line of Washington Street from said point of beginning running due West along <br />the Northern side of King Street 35.0 feet to a point, which said point is in the dividing <br />line between parcel herein conveyed and a certain strip of land, the approximate <br />dimensions are 4.45 feet by 113 feet and which said strip is more particularly described <br />by Deed of Correction and Confirmation from United Virginia Bank/Seaboard National <br />Trustee, et als. Dated March 23, 1978; thence along said dividing line North 00 25' 30" <br />West a distance of 113.14 feet (113 feet by deed description) to a point in the dividing <br />line between the parcel herein conveyed and the Southern boundary line of Parcels <br />Five and Six hereinabove described; thence along the last mentioned dividing line <br />South 890 56' 19" East a distance of 39.44 feet to a point; thence South 00 25' 30" East <br />a distance of 113.14 feet (113 feet in deed description) to a point in the North side of <br />King Street, the said point of beginning <br /> <br />3. That the use permit is approved subject to the following conditions which <br />shall be observed by the applicants and any successor in interest: <br /> <br />(a) Hours of public operation shall be between 9 a.m. and 2 a.m., Monday <br />through Saturday, and between 12 p.m. and 2 a.m. on Sunday. <br /> <br />(b) The City Building Official must approve the building's floor plan. <br /> <br />(c) The establishment shall be operated in compliance with all applicable <br />codes, ordinances, and regulations of federal, state, and local governments. <br /> <br />(d) The applicant shall obtain all required licenses and permits before <br />operation, and these licenses and permits shall remain in effect during the operation of <br />the establishment. <br />
