EXPIRATION OF PERMIT: Unless extended as provided under Section <br />40-115 of the Code of the City of Portsmouth, Virginia (1988), the group housing use <br />permit shall expire for any portion of the approved project for which building permits <br />have not been issued if the applicant fails to apply for all building permits for the entire <br />project within one year of the adoption of this resolution. <br /> <br />4. REVOCATION OF PERMIT: Violation of any of the above conditions may <br />serve as grounds for revocation of the permit by the City Council." <br /> <br />Ayes: Heretick, Moody, Psi mas, Randall, Whitehurst, Holley <br />Nays: None <br /> <br />Motion by Mr. Moody, and seconded by Mr. Psi mas, to adopt the following <br />resolution approved on first reading at the March 28, 2006 meeting, and was adopted <br />by the following vote: <br /> <br />06 - 139(d) <br /> <br />"RESOLUTION GRANTING APPROVAL OF A GROUP HOUSING USE PERMIT <br />(GHP-06-04) TO THE LAWSON COMPANIES TO CONSTRUCT 120 RESIDENTIAL <br />APARTMENT UNITS ON THE SITE OF THE CURRENT PORTSMOUTH ESTATES IN <br />THE HODGES MANOR NEIGHBORHOOD. <br /> <br />WHEREAS, The Lawson Companies has made application, pursuant to Section <br />40-112 of the Code of the City of Portsmouth, Virginia (1988), as amended, for the <br />approval and granting of a group housing use permit for 120 residential apartment units <br />on the site of the current Portsmouth Estates in the Hodges Manor neighborhood, <br />Portsmouth, Virginia; and <br /> <br />WHEREAS, the subject property is furthermore described as: <br /> <br />GHP-06-04 <br /> <br />All those 30 lots, with the buildings and improvements thereon and the <br />appurtenances thereunto belonging, situate in the City of Portsmouth, Virginia, <br />and being known, numbered and designated as Lots 6 through 20 and 45 <br />through 61, as shown on that certain plat entitled "MAP OF PORTSMOUTH <br />ESTATES PROPERTY OF PAT REALTY CORP., NORFOLK COUNTY, VA. <br />SCALE 1 "=50"', dated March 30, 1943, prepared by Jno. M.
