February 13. 2006 At a Called Meeting of the City Council on Monday, February 13, 2006, there were present: *Mayor James W. Holley III, Vice Mayor William E. Moody, Jr., Charles B. Whitehurst, Sr., Marlene W. Randall, Stephen E. Heretick, Elizabeth M. Psimas, *Ray A. Smith, Sr., City Manager James B. Oliver, Jr., City Attorney G. Timothy Oksman. 06 - 69 - The following call for the meeting was read: "Please attend a Called Meeting of the City Council to be held in the 6th Floor Conference Room, 801 Crawford Street, 5:00 p.m., Monday, February 13, 2006 for the purpose of a Public Work Session. By order of the Mayor." 06 - 70 - The following items were discussed in Public Work Session: 1. Real Estate Assessment Update - Alethia Bryce I Lance Wolff 2. Covanta Marine Terminal Project Update - John Maher 06 - 71 - Motion by Mr. Whitehurst, and seconded by Mr. Moody, to go into Closed Meeting pursuant to provisions of Section 2.2-3711 (A) of the Code of Virginia, to discuss: personnel matters, as per subsection 1 ; and the sale of publicly owned real property, as per subsection 3. The subject matter of the meeting includes an individual personnel matter and the possible sale and development of a certain real estate property on Frederick Boulevard for development as an IHOP restaurant. The purpose of the meeting is to permit confidential discussion of personnel matter and negotiating strategy for a real estate transaction. The motion was adopted by unanimous vote. Motion by Ms. Randall, and seconded by Mr. Whitehurst, pursuant to Section 2.2-3712(0) of the Code of Virginia, certifying that to the best of the Council Members' knowledge during the immediately preceding Closed Meeting of the City Council: 1. Only public business matters lawfully exempted from open meeting requirements by the Virginia Freedom of Information Act, and 2. Only such public business matters as were identified in the motion by which the Closed Meeting was convened, were heard, discussed or considered in the meeting by the City Council.
