January 30, 2006 567 At a Called Meeting of the City Council on Monday, January 30, 2006, there were present: Mayor James W. Holley III, Vice Mayor William E. Moody, Jr., Charles B. Whitehurst, Sr., Marlene W. Randall, Stephen E. Heretick, Elizabeth M. Psimas, Ray A. Smith, Sr., - City Manager James B. Oliver, Jr., City Attorney G. Timothy Oksman. 06 - 60 - The following call for the meeting was read: "Please attend a Called Meeting of the City Council to be held in the 6th Floor Conference Room, 801 Crawford Street, 5:00 p.m., Monday, January 30, 2006 for the purpose of a Closed Meeting. By order of the Mayor." 06 - 61 - Motion by Ms. Psimas, and seconded by Ms. Randall, to go into Closed Meeting pursuant to provisions of Section 2.2-3711 (A) of the Code of Virginia, to: consult with legal counsel and staff members pertaining to litigation and specific legal matters, as per subsection 7. The subject matter of the meeting will include the pending lawsuit over the Garden of Prayer church. The purpose of the meeting is to permit confidential discussion of legal strategy. The motion was adopted by unanimous vote. Motion by Mr. Whitehurst, and seconded by Ms. Randall, pursuant to Section 2.2-3712(0) of the Code of Virginia, certifying that to the best of the Council Members' knowledge during the immediately preceding Closed Meeting of the City Council: 1. Only public business matters lawfully exempted from open meeting requirements by the Virginia Freedom of Information Act, and 2. Only such public business matters as were identified in the motion by which the Closed Meeting was convened, were heard, discussed or considered in the meeting by the City Council.
