January 24.2006 1. That the use for which the permit hereinafter-described is sought: (a) Will not adversely affect the health and safety of persons residing or working in the neighborhood of the proposed use; (b) Will not be detrimental to the public use or injurious to the property or improvements in the neighborhood; (c) Will be provided with sufficient landscaping to insure compatibility with surrounding uses; (d) Will be a project that will be developed according to a plan for parking, driveways, and curb cuts which will provide for safe and convenient traffic movement; and (e) Will be in accordance with the purposes of the City of Portsmouth Zoning Ordinance. 2. That a use permit is hereby granted pursuant to Section 40-43.1 of the Code of the City of Portsmouth, Virginia (1988) for the operation of a parking lot with 3310 Deep Creek Boulevard, and being more particularly described as: UP-05-35 Beginning at the southwest corner of Portsmouth Boulevard and Deep Creek Boulevard; thence, in a westerly direction 321.28'::1: to a point; thence, in a southerly direction 105'::1: to a point; thence, in a westerly direction 56'::1: to a point; thence, in a southerly direction 105'::1: to a point; thence, in an easterly direction 279.5'::1: to a point; thence, in a northeasterly direction 219.68'::1: to a point of the beginning. 3. That the use permit is approved subject to the following conditions which the applicant and any successor in interest shall observe: (a) The new parking area may not exceed forty-two (42) parking spaces. (b) The applicant shall comply with the approved site and landscaping plans for the parking lot area. (c) The project shall adhere to the Site Plan Review Process after the approval of the Use Permit. (d) During the Site Plan Review Process, the applicant shall provide a detailed sanitary sewer and water design, which defines the services required for the site. (e) Parking lot improvements shall be reviewed and approved by the Commission of Architectural Review for the Truxtun Neighborhood. (f) The applicant shall comply with all applicable codes, ordinances and regulations of federal, state and local governments and shall obtain and maintain all required licenses and permits. 4. REVOCATION OF PERMIT: Violation of any of the above conditions may serve as grounds for revocation of the use permit by the City Council."
