<br />January 24.2006 <br /> <br />1. That the use for which the permit hereinafter-described is sought: <br /> <br />(a) Will not adversely affect the health and safety of persons residing or <br />working in the neighborhood of the proposed use; <br /> <br />(b) Will not be detrimental to the public use or injurious to the property or <br />improvements in the neighborhood; <br /> <br />(c) Will be provided with sufficient landscaping to insure compatibility with <br />surrounding uses; <br /> <br />(d) Will be a project that will be developed according to a plan for parking, <br />driveways, and curb cuts which will provide for safe and convenient traffic movement; <br />and <br /> <br />(e) Will be in accordance with the purposes of the City of Portsmouth Zoning <br />Ordinance. <br /> <br />2. That a use permit is hereby granted pursuant to Section 40-43.1 of the <br />Code of the City of Portsmouth, Virginia (1988) for the operation of a parking lot with <br />3310 Deep Creek Boulevard, and being more particularly described as: <br /> <br />UP-05-35 <br /> <br />Beginning at the southwest corner of Portsmouth <br />Boulevard and Deep Creek Boulevard; thence, in a westerly <br />direction 321.28'::1: to a point; thence, in a southerly direction <br />105'::1: to a point; thence, in a westerly direction 56'::1: to a <br />point; thence, in a southerly direction 105'::1: to a point; <br />thence, in an easterly direction 279.5'::1: to a point; thence, in <br />a northeasterly direction 219.68'::1: to a point of the <br />beginning. <br /> <br />3. That the use permit is approved subject to the following conditions which <br />the applicant and any successor in interest shall observe: <br /> <br />(a) The new parking area may not exceed forty-two (42) parking spaces. <br /> <br />(b) The applicant shall comply with the approved site and landscaping plans <br />for the parking lot area. <br /> <br />(c) The project shall adhere to the Site Plan Review Process after the <br />approval of the Use Permit. <br /> <br />(d) During the Site Plan Review Process, the applicant shall provide a <br />detailed sanitary sewer and water design, which defines the services required for the <br />site. <br /> <br />(e) Parking lot improvements shall be reviewed and approved by the <br />Commission of Architectural Review for the Truxtun Neighborhood. <br /> <br />(f) The applicant shall comply with all applicable codes, ordinances and <br />regulations of federal, state and local governments and shall obtain and maintain all <br />required licenses and permits. <br /> <br />4. REVOCATION OF PERMIT: Violation of any of the above conditions may <br />serve as grounds for revocation of the use permit by the City Council." <br />
