November 22. 2005 UP-05-31 All that certain lot or parcel of land, with its appurtenances, situate in the City of Portsmouth, Virginia, and bounded and described as follows, to wit: Beginning at a point on the eastern side of Rapidan Street, distant 235.43 feet, more or less (measured along the eastern line of Rapidan Street) northerly from the northwest intersection of Rapidan Street and Greenwood Drive, and from thence running N.650 18' 18" E. 150 feet; thence northerly along a line distant 150 feet from the eastern side of Rapidan Street 99.375 feet, more or less; thence S. 650 04' W. 150 feet to Rapidan Street; and thence south along the eastern line of Rapidan Street on a curve 98.75 feet to the point of beginning. 3. That the use permit is approved subject to the following conditions which shall be observed by the applicant and any successor in interest: (a) The maximum occupancy of the facility shall not exceed 45 children at any time. (b) The age range of the children shall be from 2 % years to twelve years of age. (c) The days and hours of operation shall be Monday through Friday, 6:00 a.m. to 6:00 p.m. (d) Outdoor play hours shall be limited to between the hours of 8:00 a.m. and dusk. (e) The 3,000 square foot play area shall be maintained and shall be enclosed with fencing that is at least four feet in height. (f) The east-facing portion of the outdoor play area fence (adjacent to the used car lot) shall be of a solid fencing material, e.g. wood. (g) No more than 30 children shall occupy the play area at anyone time. (h) All drop off and pick up of children shall take place through the church parking lot. No street drop off or pick up shall be permitted. (i) The existing landscaping shall remain and shall be maintained. Any replacement of the existing landscaping shall be in kind. (j) Refuse collection shall be by private collection contract as approved by the Department of General Services (k) The center shall be operated and maintained in accordance with all required inspections by the City's Fire Department Bureau, Public Health Department and the Building Official. This condition shall be deemed to include an initial inspection prior to the opening of the business and annual inspections thereafter. (I) The center shall be operated in compliance with all applicable codes, ordinances and regulations of federal, state and local governments, and the operator shall obtain and maintain in effect all necessary licenses and permits. (m) Any taxes and fees associated with the operation shall be paid when due. 4. REVOCATION OF PERMIT: Violation of any of the above conditions may serve as grounds for revocation of the use permit by the City Council."
