<br />November 8. 2005 <br /> <br />Ayes: Heretick, Moody, Psi mas, Randall, Smith, Whitehurst, Holley <br />Nays: None <br /> <br />05 - 503 - Adoption of a resolution authorizing the City Manager to execute a contract, <br />deed and other instruments necessary to convey two strips of land adjacent to the <br />Highland Biltmore Elementary School to the Economic Development Authority of the <br />City of Portsmouth for their conveyance to a developer for their use in the construction <br />of housing. Vision Principle: Bold New Directions. <br /> <br />Background: <br />. The depth of land between the Highland Biltmore Elementary School and <br />Greenwood Drive on the south and DeKalb Avenue on the north is insufficient in depth <br />between the school property and the streets to allow the development of those areas. <br />Hence, the potential developer has asked that the EDA convey them a strip of land <br />along the school's southern and northern boundaries. <br />. In return for the conveyance of the two strips of land to be acquired by the <br />developer, the developer proposes to donate to the City a parcel of land at the western <br />boundary of the school of approximately 1.2 acres, and an area of approximately 0.5 <br />acres at the northwest intersection of Greenwood Drive and Independence Street for <br />expansion and improvements to the school site. <br />. The developer will be required to erect new fencing around the redefined <br />boundaries of the school, as approved by the Director of Planning and the <br />Superintendent of Schools, at the developers sole expense. <br /> <br />Discussion: <br />. Financial Impact: The properties will be exchanged, and no financial impact will <br />be incurred with the conveyances. However, the developer will have the ability to <br />develop a strip of land along DeKalb Avenue of approximately 677 feet in length, and an <br />area along Greenwood Drive of approximately 595 feet in length. <br /> <br />Staff Recommends: <br />Adoption of a Resolution authorizing the City Manager to execute a contract, deed and <br />other instruments necessary to convey two strips of land adjacent to the Highland <br />Biltmore Elementary School to the Economic Development Authority of the City of <br />Portsmouth for their conveyance to a developer for their use in the construction of <br />housing. Vision Principle: Bold New Directions. <br /> <br />Next Steps following City Council Action: <br />. The City Manager will execute the Contract and later deed to convey strips to the <br /> <br />EDA. <br /> <br />. The Offices of the City Attorney and City Surveyor will draft appropriate plats and <br />documents in order to effectuate the property exchange. <br /> <br />Motion by Ms. Psi mas, and seconded by Mr. Whitehurst, to adopt the following <br />resolution, and was adopted by the following vote: <br /> <br />"A RESOLUTION AUTHORIZING THE CITY MANAGER TO EXECUTE A <br />CONTRACT, DEED AND OTHER DOCUMENTS AS MAY BE NECESSARY TO <br />CONVEY TWO STRIPS OF LAND AT THE HIGHLAND BILTMORE ELEMENTARY <br />SCHOOL TO THE ECONOMIC DEVELOPMENT AUTHORITY OF THE CITY OF <br />PORTSMOUTH, VIRGINIA. <br /> <br />BE IT RESOLVED by the Council of the City of Portsmouth, Virginia, that the <br />City Manager be, and he hereby is, authorized to execute a contract, deed and such <br />other documents as may be necessary to effect the conveyance of two strips of land of <br />approximately 20 feet and 17 feet along the northern and southern boundaries of the <br />Highland Biltmore Elementary School to the Economic Development Authority of the <br />City of Portsmouth, Virginia." <br /> <br />Ayes: Heretick, Moody, Psi mas, Randall, Smith, Whitehurst, Holley <br />Nays: None <br />
