<br />November 8. 2005 <br /> <br />Next Steps Following Council Action: <br />. Finance Department, HRM, and Retirement Board will cooperate in <br />communicating this new ordinance to members of the City's two retirement systems. <br />. All applications for the purchase of prior VRS service credits will be reviewed by <br />both staff and the City's professional actuarial consultant to ensure that fair and <br />revenue-neutral purchase prices are determined for official approval by the Board of <br />Trustees of the City of Portsmouth Retirement System. <br /> <br />Motion by Mr. Moody, and seconded by Mr. Whitehurst, to adopt the following <br />ordinance, and was adopted by the following vote: <br /> <br />"ORDINANCE TO AMEND CHAPTER 30 OF THE CODE OF THE CITY OF <br />PORTSMOUTH, VIRGINIA (1988) BY AMENDING SECTIONS 30-100 AND 30-221 <br />THEREOF TO REMOVE THE TIME LIMIT FOR PURCHASING CREDITABLE <br />VIRGINIA RETIREMENT SYSTEM SERVICE FOR EMPLOYED MEMBERS OF THE <br />PORTSMOUTH SUPPLEMENTAL RETIREMENT SYSTEM AND THE PORTSMOUTH <br />FIRE AND POLICE RETIREMENT SYSTEM." <br /> <br />Ayes: Heretick, Moody, Psi mas, Randall, Smith, Whitehurst, Holley <br />Nays: None <br /> <br />05 - 499 - Adoption of an ordinance concerning the tenure of appointees to boards and <br />commissions. There is no financial impact on the City. Vision Principle: Bold New <br />Directions. <br /> <br />Background: <br />. For most boards and commissions appointed by City Council, the appointees <br />may be removed by City Council. There are various different criteria and procedures for <br />removal between different boards and commissions. However, due to apparent <br />oversights in drafting, there are a small number of boards and commissions for which <br />there is no way to remove an appointee. The proposed ordinance would close that <br />loophole. <br /> <br />Discussion: <br />. The power of removal is an important check and balance in all levels of our <br />system of government. Here, it helps to ensure that all Council appointees to boards <br />and commissions continue to serve the public properly, and to permit the removal of <br />those who do not. <br />. Boards and commissions for which there is presently a power of removal will not <br />be affected by this ordinance. The ordinance deals only with boards and commissions <br />for which there is no power of removal specified. <br />. The ordinance is not applicable to independent political subdivisions for which <br />the governing bodies are appointed by Council, and for which state law already covers <br />removals, such as PRHA or the EDA. <br />. Financial Impact: There is no financial impact to the City. <br /> <br />Staff Recommends: <br />Adoption of an Ordinance concerning the tenure of appointees to boards and <br />commissions. There is no financial impact on the City. Vision Principle: Bold New <br />Directions. <br /> <br />Next Steps Following Council Action: <br />. City Clerk to transmit ordinance to Municipal Code Commission for inclusion in <br />City Code. <br /> <br />Motion by Ms. Psi mas, and seconded by Mr. Whitehurst, to adopt the following <br />ordinance, and was adopted by the following vote: <br /> <br />"ORDINANCE TO AMEND CHAPTER 2 OF THE CODE OF THE CITY OF <br />PORTSMOUTH, VIRGINIA (1988) BY ADDING THERETO A NEW SECTION 2-34, <br />PROVIDING FOR REMOVAL OF APPOINTEES TO CERTAIN APPOINTED <br />BODIES." <br />
