November 8. 2005 At a Called Meeting of the City Council on Tuesday, November 8, 2005, there were present: *Mayor James W. Holley III, Vice Mayor William E. Moody, Jr., Charles B. Whitehurst, Sr., Marlene W. Randall, Stephen E. Heretick, Elizabeth M. Psimas, Ray A. Smith, Sr., City Manager James B. Oliver, City Attorney G. Timothy Oksman. 05 - 486 - The following call for the meeting was read: "Please attend a Called Meeting of the City Council to be held in the 6th Floor Conference Room, 801 Crawford Street, 6th floor, 5:00 p.m., Tuesday, November 8, 2005 for the purpose of a Public Work Session. In addition, you may consider a motion to go into a Closed Meeting. By order of the Mayor." 05 - 487 - The following items were discussed in Public Work Session: 1. EPA Regional SSO Consent Order - Jim Spacek 2. 2006 Legislative Agenda - Sherri Neil 3. Downtown/Midtown Development Update - John Rowe and Kathy Warren 4. Review of City Manager's Report Items - John Rowe 5. Real Estate Tax Rate - Lance Wolff 6. Vision Related Strategic Action Plan Update - John Maher 05 - 488 - Motion by Ms. Psimas, and seconded by Mr. Moody, to go into Closed Meeting pursuant to provisions of Section 2.2-3711 of the Code of Virginia, to discuss: appointments to boards and commissions as per subsection 1; the performance of individual officials of the City, as per subsection 1; and the sale of publicly owned real property, as per subsection 3. The subject matter shall be appointments to boards and commissions, official performance, and the possible sale of publicly owned real estate in the downtown area of the City. The purpose shall be to permit discussion of appointments and official performance; and also to discuss negotiating strategy for real estate. The motion was adopted by unanimous vote. Motion by Mr. Heretick, and seconded by Mr. Moody, pursuant to Section 2.2- 3712(0) of the Code of Virginia, certifying that to the best of the Council Members' knowledge during the immediately preceding Closed Meeting of the City Council: 1. Only public business matters lawfully exempted from open meeting requirements by the Virginia Freedom of Information Act, and 2. Only such public business matters as were identified in the motion by which the Closed Meeting was convened, were heard, discussed or considered in the meeting by the City Council.
